Abstract
Penguatan pengaturan lembaga jasa keuangan dalam memberikan kepastian hukum terhadap nasabah dan debitur terkait aspek hukum Secondary Mortgage Facility (SMF) di Indonesia merupakan hal yang penting dalam mengembangkan pasar perumahan yang berkelanjutan. Dalam konteks ini, kepastian hukum diperlukan untuk memastikan perlindungan hak nasabah dan debitur, serta menjamin keadilan dalam transaksi SMF. Penelitian ini dilakukan menggunakan aspek hukum dan sosiologis fokus pada studi tentang nasabah atau masyarakat dan investor dalam interaksi sosial. Berdasarkan hasil analisis yang telah dilakukan oleh peneliti, kesimpulan penelitian ini menunjukkan bahwa perkembangan Pasar Sekunder Kreditur asal dilindungi oleh undang-undang dan peraturan terkait, seperti UU Perbankan, UU Perlindungan Konsumen, dan POJK tentang Pembiayaan Sekunder Perumahan. Perlindungan hukum tersebut meliputi hak untuk mendapatkan informasi yang jelas dan benar, hak untuk memilih lembaga pembiayaan sekunder, dan hak untuk mengajukan keberatan dan gugatan. Investor dilindungi oleh undang-undang dan peraturan terkait, seperti UU Pasar Modal, UU Efek, dan POJK tentang Pembiayaan Sekunder Perumahan. Serta mekanisme yang jelas dalam penanganan agunan jika terjadi kredit macet. Terdapat celah hukum yang perlu di perhatikan terkait gagal bayar oleh SMF sehingga diperlukan upaya pencegahan. Selain itu perlu dibuat aturan hukum baru dan pembaharuan regulasi yang menyempurnakan aturan lama dan memperkuat lagi. Saran pada penelitian ini adalah perlunya efektivitas POJK menganalisis, mengevaluasi dan memperkuat pengawasan serta meningkatkan koordinasi agar memperkuat SMF di Indonesia. Rekomendasi dalam penelitian ini adalah perlunya penelitian lanjutan serta menggunakan metode dan penggunaan data disamping Cost Benefit Analyze yang menghasilkan Regulatory Impact Assement yang akurat yang melibatkan semua pemangku kepentingan agar penerapan SMF menjadi lebih kuat. Serta perlunya sistem, komunikasi dan layanan yang baik serta perbaikan kebijakan yang update agar implementasi SMF di Indonesia menjadi lebih baik dan Kuat. / Strengthening the regulation of financial service institutions in providing legal certainty to customers and debtors regarding the legal aspects of the Secondary Mortgage Facility (SMF) in Indonesia is important in developing a sustainable housing market. In this context, legal certainty is needed to ensure the protection of customer and debtor rights, as well as guarantee fairness in SMF transactions. This research was conducted using a Law and sociological aspect, focus on the study of customers or society and investors in social interactions. Based on the results of the analysis carried out by researchers, the conclusion of this research shows that the development of the Primary Creditor Secondary Market is protected by related laws and regulations, such as the Banking Law, Consumer Protection Law, and POJK concerning Secondary Housing Financing. This legal protection includes the right to obtain clear and correct information, the right to choose a secondary financing institution, and the right to file applications and lawsuits. Investors are protected by relevant laws and regulations, such as the Capital Markets Law, Securities Law, and POJK concerning Secondary Housing Financing. As well as a clear mechanism for handling finances if credit congestion occurs. There are legal loopholes that need to be considered regarding failure to pay by SMF so prevention efforts are needed. Apart from that, it is necessary to create new legal rules and update regulations that improve old rules and strengthen them further. The suggestion in this research is the need for the effectiveness of POJK to analyze, implement and strengthen supervision and improve coordination in order to strengthen SMF in Indonesia. The recommendation in this research is the need for further research by Cost Benefit Analyze the has a Regulatory Impact Assement and using accurate methods and data that involves all stakeholders so that the implementation of SMF becomes stronger. There is a need for good systems, communication and services as well as updated policy improvements so that SMF implementation in Indonesia becomes better and stronger.
