Abstract

Digital disruption has successfully modernized economic transactions through the presence of e-commerce platforms. Through e-commerce, the society, especially consumers and business entities are able to ease the process of purchasing and selling transactions without the need to meet each other face to face. However, behind the convenience provided, the presence of e-commerce in fact also brings several legal disputes that put consumers in a disadvantageous position, whether in the form of material or immaterial losses. For that reason, this research is conducted with the aim of solving as well as finding solutions to consumer protection problems by using normative empirical research to examine the current legal arrangements for consumer protection and then relating them to the empirical conditions that occur in society, using secondary data in the form of books and journals, as well as primary data obtained through interviews. The results of this research then show that the presence of a Reliability Certification Body that provides certificates to business entities to be later imprinted in the form of a trust stamp can be used as one of the concrete solutions to overcome existing legal disputes. The establishment of this institution has long been regulated in several written legal regulations in Indonesia, but unfortunately the real implementation of this institution has never been actualised. Meanwhile, by conducting a comparative study with Singapore and the European Union, this institution has been able to prove its success in providing a guarantee of trust and safety for consumers when they use online transactions. So in order to implement this institution in Indonesia, it is necessary to reform the consumer protection law to regulate the presence of this institution, both in terms of its position, its standardization, and its legal consequences. Moreover, it is also necessary to synchronize the current consumer protection law with other related legal regulations in order to achieve the most optimized legal protection for the Indonesian consumers.
