Abstract

Indonesia is committed to reducing carbon emissions through the Paris Agreement, which drives the development of nuclear energy as part of efforts to achieve national energy independence. However, Law Number 10 of 1997 on Nuclear Energy, which has been in effect for 27 years, has not undergone significant updates. This study aims to analyze Indonesia's readiness in realizing a Green Economy through the development of Nuclear Power Plants, particularly in terms of policy progressiveness and nuclear energy institutional frameworks. The results of the study indicate that Law Number 10 of 1997 has not kept pace with technological developments and international regulatory standards and may create policy overlaps with the enactment of the New Energy Bill. In terms of institutional aspects, bureaucratic challenges and compliance with institutional standards set by the International Atomic Energy Agency remain unresolved. This study concludes that updating Law Number 10 of 1997 is necessary to align with nuclear energy technological advancements and to reconsider its applicability concerning the New and Renewable Energy Bill. Furthermore, enforcement against institutional violations outlined in Law Number 10 of 1997 and adherence to international institutional standards must be well-established to avoid overlaps with the existence of current nuclear energy institutions. The research method used is normative legal research with qualitative analysis, along with semi-structured interviews with stakeholders in the nuclear energy sector.
