Abstract

Songs and music, as intellectual creations, are protected under Indonesia's Copyright Law No. 28 of 2014 as they are the product of human thought, creativity, skill, and intelligence. Musicians create these works as a means of expressing their emotions, thoughts, and stories. But on the other side, they also make it as their source of income by commercializing these songs and/or musics to the market. Before the digital era, the commercialization was done through conventional music stores that sold cassettes, CDs, and LPs. However, the digital age has significantly impacted the commercialization of song and/or music, with digital platforms like Spotify becoming the primary mode of song and/or music distribution. While digitalization offers many benefits, it has also led to the emergence of Spotify MOD, which infringes on the copyright of musicians, in articular, their economic rights on the creation. This study examines the legal certainty of digital song and/or music copyrights in Indonesia and the legal protections available to musicians whose songs and/or musics are found on Spotify MOD. Employing a normative-empirical research method, this study analyzes relevant regulations supported by interviews with experts and/or relevant informants, in order to solve the research problem. The results obtained from this research reveals that while Law No. 28 of 2014 provides legal certainty for the general concept of songs and/or music copyright, there is still a need for more technical regulations regarding the digital song and/or music in Indonesia. Moreover, preventive legal protection has been provided to musicians specifically through the provisions of Articles 54 to 56 of Law No. 28 of 2014, and legal remedies that can be taken. However, it is crucial to focus on enhancing the enforcement efforts of law enforcement officers to provide repressive legal protection against the existence of pirated sites or applications such as Spotify MOD.
