PT. TONG SHEN ENTERPRISE CO., LTD yang memiliki merek terdaftar yang sama pada pokoknya atau keseluruhannya dengan merek yang didaftarkan oleh PT. INTI JAYA LEMINDO yang mana kedua perusahaan tersebut memiliki bidang industri yang sama yakni Lem atau Perekat. Dalam penelitian ini, pengumpulan data menggunakan pendekatan terhadap kasus hukum yaitu Putusan Mahkamah Agung Nomor 54 PK/Pdt.Sus-HKI/2023. Selanjuntya terkait pengaturan mekanisme pendaftaran Merek untuk mendapatkan perlindungan hukum di Indonesia dan implementasi Perlindungan Hukum terhadap PT Tong Shen Enterprise Co., Ltd. maka dapat disimpulkan tata cara pendaftaran merek diatur dalam Peraturan Menteri Nomor 12 Tahun 2021 tentang Pendaftaran Merek. Pasal 3 UU MIG menyatakan bahwa perlindungan hukum terhadap merek hanya diberikan kepada merek yang sudah terdaftar. Berdasarkan ketentuan Pasal 20 UU Merek dan Indikasi Geografis dan Pasal 21 ayat (1) mengatur kriteria merek yang tidak dapat didaftarkan beserta dasar penolakan pendaftaran merek yang akan dilakukan oleh DJKI. Konsep perlindungan hukum untuk pemilik Merek berkaitan dengan karakteristik hak Merek yang bersifat eksklusif. Yakni perlindungan merek akan diberikan kepada pihak pertama yang lebih dulu mendaftarkan mereknya (first to file). Putusan Nomor 101/Pdt.Sus-HKI/Merek/2022/PN.Jkt Pst telah memberikan perlindungan hukum kepada Tong Shen Enterprises Co., Ltd karena secara prosedur guna memberikan perlindungan kepada merek barang tersebut sudah sesuai dengan apa yang sudah dilakukan. Namun dengan adanya putusan perkara nomor 54 PK/Pdt.Sus HKI/2023 yang membuat dibatalkannya putusan pengadilan tersebut. / PT. INTI JAYA LEMINDO where both companies have the same industrial sector, namely Glue or Adhesive. In this research, data collection uses an approach to legal cases, namely Supreme Court Decision Number 54 PK/Pdt.Sus-HKI/2023. Furthermore, it is related to the regulation of Trademark registration mechanisms to obtain legal protection in Indonesia and the implementation of Legal Protection for PT Tong Shen Enterprise Co., Ltd. So it can be concluded that the procedures for trademark registration are regulated in Ministerial Regulation Number 12 of 2021 concerning Trademark Registration. Article 3 of the MIG Law states that legal protection for brands is only given to registered brands. Based on the provisions of Article 20 of the Trademark and Geographical Indications Law and Article 21 paragraph (1), it regulates the criteria for marks that cannot be registered along with the grounds for rejection of mark registration which will be carried out by the DJKI. The concept of legal protection for brand owners is related to the characteristics of exclusive brand rights. Namely, brand protection will be given to the first party who registers their brand first (first to file). Decision Number 101/Pdt.Sus HKI/Merek/2022/PN.Jkt Pst has provided legal protection to Tong Shen Enterprises Co., Ltd because the procedure for providing protection to the brand of goods is in accordance with what has been done. However, the decision in case number 54 PK/Pdt.Sus-HKI/2023 resulted in the cancellation of the court decision.
