Abstract
Penelitian ini membahas penerapan perlindungan hukum bagi penyandang
disabilitas dalam pembuatan akta autentik, dengan fokus pada Undang-Undang
Jabatan Notaris dan Undang-Undang Penyandang Disabilitas di Indonesia. Kajian
ini menilai sejauh mana regulasi yang ada menjamin kesetaraan dan aksesibilitas
bagi penyandang disabilitas dalam layanan kenotariatan. Melalui analisis hukum
dan studi kasus, penelitian ini menemukan beberapa kendala signifikan yang
dihadapi oleh penyandang disabilitas fisik dan sensorik dalam mengakses layanan
notaris. Hambatan utama meliputi tidak tersedianya penerjemah bahasa isyarat
untuk penyandang tunarungu, minimnya dokumen dalam huruf Braille untuk
tunanetra, serta kurangnya penyesuaian prosedural yang memastikan keterlibatan
setara. Kendala ini sering kali membatasi akses penyandang disabilitas terhadap
keadilan, bertentangan dengan prinsip kesetaraan yang diatur dalam hukum
nasional maupun internasional. Penelitian ini merekomendasikan langkah-langkah
untuk meningkatkan aksesibilitas, seperti penyediaan fasilitas komunikasi yang
ramah disabilitas, pelatihan inklusif bagi notaris, dan penguatan perlindungan
hukum. Temuan ini bertujuan mendorong reformasi hukum yang mendukung
pengembangan layanan kenotariatan yang inklusif, adil, dan sesuai dengan hak

with disabilities in the drafting of authentic deeds, focusing on the application of
the Notary Position Act and the Disabilities Act in Indonesia. It examines how
existing laws and regulations uphold equality and ensure access to notarial services
for persons with disabilities. Through a combination of legal analysis and case
studies, the study identifies significant obstacles faced by individuals with sensory
and physical impairments during the preparation of deeds. Key barriers include
inadequate accommodation, such as the unavailability of interpreters for those with
hearing impairments and limited access to Braille documents for individuals with
visual impairments. The study emphasizes the importance of addressing these
issues to guarantee inclusive and equitable legal processes. Recommendations are
provided to enhance procedural accessibility, align practices with human rights
standards, and raise awareness among notaries about the specific needs of persons
with disabilities. By identifying gaps and proposing practical solutions, this
research contributes to the ongoing dialogue on disability rights and supports the
development of notarial practices that are inclusive and equitable. Ultimately, it
seeks to advance the broader goal of ensuring justice and equal treatment for all
individuals within Indonesia’s legal framework.
