Abstract
Tesis ini membahas pengaturan tentang peran notaris dalam memberikan perlindungan hukum kepada konsumen apartemen dan memaparkan urgensi dari peran notaris dalam memberikan perlindungan hukum kepada konsumen apartemen dalam studi putusan nomor 45/Pdt.G/2019/PN Jkt Sel. Metode penelitian yang digunakan adalah jenis penelitian yuridis normatif melalui studi kepustakaan. Hasil penelitian menunjukan pengaturan jual-beli tanah dan bangunan termasuk apartemen wajib dibuat dengan AJB di hadapan PPAT; namun apabila AJB tidak dapat dilakukan, karena tidak memenuhi persyaratan seperti: proses pembangunan sedang berlangsung, maka dapat dilakukan dengan PPJB yang dibuat di hadapan notaris, sebagaimana diatur dalam Peraturan Pemerintah nomor 12 Tahun 2021 yang mewajibkan pembuatan PPJB dalam bentuk akta notaris. Urgensi notaris dalam pembuatan PPJB apartemen memberikan banyak manfaat dalam hal kepastian hukum, perlindungan konsumen, dan penegakan keadilan dalam transaksi jual-beli properti. Hal ini disebabkan karena notaris sebagai pejabat umum yang berwenang membuat akta otentik mempunyai kewajiban membacakan dan memberikan penyuluhan hukum sesuai dengan pasal 15 ayat (2) huruf e dan pasal 16 ayat (1) huruf m UUJN. Keharusan melibatkan notaris tidak hanya melindungi konsumen, tetapi juga membantu membangun iklim bisnis apartemen yang lebih sehat dan terpercaya, di mana semua pihak memiliki kepastian dan keamanan dalam bertransaksi. / This thesis discusses the regulation on the role of notaries in providing legal protection to apartment consumers and explains the urgency of the role of notaries in providing legal protection to apartment consumers in the study of decision number 45/Pdt.G/2019/PN Jkt Sel. The research method used is a type of normative juridical research through literature study. The results of the study show that the regulation of the sale and purchase of land and buildings including apartments must be made with AJB before the PPAT; However, if the AJB cannot be carried out because it does not meet the requirements such as: the construction process is in progress, then it can be done with a PPJB made before a notary, as regulated in Government Regulation Number 12 of 2021 which requires the making of a PPJB in the form of a notarial deed. The urgency of a notary in making an apartment PPJB provides many benefits in terms of legal certainty, consumer protection, and enforcement of justice in property sale and purchase transactions. This is because a notary as a public official authorized to make an authentic deed has an obligation to read and provide legal counseling in accordance with Article 15 paragraph (2) letter e and Article 16 paragraph (1) letter m UUJN. The requirement to involve a notary not only protects consumers, but also helps build a healthier and more trusted apartment business climate, where all parties have certainty and security in their transactions.
