Abstract
Health is a part of wellness that must be achieved thoroughly with various health efforts for the Indonesian nation. To ensure it, the government is trying to improve the quality and health standards by performing BPJS. This thesis discusses the phenomenon of differences in health services received between BPJS patients and non-BPJS patients.This problem causes the implementation of health services to be less optimal and hinders the equalization of health services.Hospital discriminatory actions are aggravated by the refusal to handle emergency patients. In fact, the Health Law Number 17 of 2023 in Article 174 paragraph (2), states that in emergency conditions, hospitals are prohibited from refusing treatment and asking for advance payments, and prioritizing administrative matters that can result in delayed health services.The purpose of the research is to know the norms of health services in hospitals in realizing equality for BPJS patients and to know the implementation of hospital services in handling patients based on the principle of equality. The research method uses normative laws with an empirical approach. The case example used is Decision Number 779/Pdt.G/2021/PN tng. Based on the research results, it can be taken, namely: 1) Hospitals that violate their obligations are subject to administrative sanctions in the form of reprimands, fines, and revocation of hospital permits. 2) Hospital services must be carried out responsibly, safely, with quality, non-discriminatory and fair. The advice given by the hospital is obliged to maintain the quality of health services as a reference in serving patients.
