Abstract
Tanah merupakan kebutuhan manusia yang mendasar. Dalam keadaan tertentu dimana Akta Jual Beli di hadapan Pejabat Pembuat Akta Tanah belum dapat dibuat maka para pihak membuat Perjanjian Pengikatan Jual Beli Lunas sebagai dasar peralihan hak. Permasalahan kerap dijumpai ketika pelaku pembangunan dinyatakan pailit sehingga menimbulkan ketidakjelasan status apakah tanah yang merupakan objek perjanjian tersebut telah beralih ke pembeli atau masih milik pelaku pembangunan sebagaimana dalam Putusan Mahkamah Agung Nomor 395K/Pdt.Sus-Pailit/2024. Tujuan penelitian ini adalah untuk memecahkan permasalahan hukum sehubungan dengan ketidakpastian Perjanjian Pengikatan Jual Beli Lunas sebagai dasar peralihan hak serta memperdalam dan memperluas pengetahuan yang ada. Penelitian ini merupakan penelitian normatif empiris yang menggunakan pendekatan kasus hukum, perundang-undangan dan konseptual. Penelitian menyimpulkan bahwa kekuatan hukum Perjanjian Pengikatan Jual Beli Lunas sebagai dasar peralihan hak lemah karena hanya melahirkan hubungan hukum berdasarkan Kitab Undang-Undang Hukum Perdata namun tidak dapat digunakan secara langsung sebagai alat bukti untuk pendaftaran peralihan hak karena tidak memenuhi persyaratan pendaftaran sebagaimana dalam Pasal 37 Peraturan Pemerintah Nomor 24 Tahun 1997. Kedudukan pembeli menjadi lebih kuat dengan adanya Putusan Pengadilan yang melegitimasi kedudukannya sebagai pembeli beriktikad baik dan pemilik sah atas tanah./ Land is a fundamental human need. In certain circumstances where Sale and Purchase Deed before Land Deed Official cannot be made, the parties enter into Conditional Sale Purchase Agreement in Full Settlement (hereinafter referred to PPJB Lunas) which serves as basis for transferring rights. Problems are often encountered when developer is declared bankrupt, resulting in an unclear status whether the land which is the agreement’s object has been transferred to purchaser or still belongs to developer as in Supreme Court Decision Number 395 K/Pdt.Sus- Pailit/2024. This study aims to solve legal problems on the uncertainty of PPJB Lunas as basis for transferring rights and to deepen and expand existing knowledge on the subject. This study is an empirical normative study that employs case study, statute and conceptual approaches. This study concludes that legal force of PPJB Lunas as basis for transferring rights is weak because it only establishes legal relationship based on Civil Code but cannot serve directly as evidence for registering the transferring rights because it does not meet registration requirements as stipulated under Article 37 of Government Regulation Number 24 of 1997. The purchaser's position is strengthened with existence of Court Decision that legitimizes his position as a good-faith purchaser and the land’s legal owner.
