Abstract
Angkutan truk memegang peranan penting di Indonesia. Lebih dari 91% pengiriman menggunakan moda ini. Namun, kecelakaan lalu lintas yang melibatkan truk menduduki peringkat kedua setelah sepeda motor. Perusahaan angkutan truk diharuskan membuat, memelihara, dan menerapkan Sistem Manajemen Keselamatan Perusahaan Angkutan Umum (SMK-PAU) sesuai dengan peraturan. Namun, sedikit perusahaan yang mematuhinya, yang diduga menjadi penyebab tingginya angka kecelakaan. Teori implementasi kebijakan digunakan untuk memaksimalkan penerapan peraturan guna menekan angka kecelakaan. Tujuan penelitian adalah untuk mengatasi permasalahan kurangnya penerapan SMK-PAU pada perusahaan angkutan truk guna menciptakan keselamatan transportasi, selain itu meningkatkan keunggulan kompetitif dan mengembangkan SMK-PAU berdasarkan Peraturan Menteri Perhubungan Nomor 85 Tahun 2018 yang lebih efisien dan efektif. Metode penelitian adalah penelitian hukum normatif empiris dan bersifat kualitatif. Data yang digunakan adalah data primer dari wawancara langsung (terstruktur maupun tidak) dan data sekunder melalui studi pustaka untuk memperoleh hasil relevan (peraturan perundang-undangan, putusan pengadilan, dan lain-lain). Pendekatan perundang-undangan dan kontekstual digunakan dalam menganalisis data. Tidak semua perusahaan memahami SMK-PAU secara memadai karena kurangnya kompetensi, terutama perusahaan kecil yang tidak memiliki sumber daya, waktu, dan kompetensi. Tidak semua perusahaan menerapkan sepuluh elemen SMK-PAU. Namun, perusahaan meyakini peningkatan daya saing dengan berkurangnya kecelakaan. Penerapan SMK-PAU belum optimal karena rumitnya perizinan. Koordinasi antar lembaga perlu ditingkatkan, karena menghambat penerapan SMK-PAU. Selain itu, jumlah pelaksana kebijakan kurang memadai. Penguatan sanksi terhadap perusahaan dapat meningkatkan efektivitas penerapan SMK-PAU. Penerapan SMK-PAU dapat mengurangi kecelakaan angkutan barang. Pemerintah perlu meningkatkan koordinasi antar lembaga dengan mengoptimalkan peran Forum Lalu Lintas dan Angkutan Jalan untuk memaksimalkan penerapan kebijakan ini. SMK-PAU harus diterapkan untuk perizinan lainnya yang menggunakan truk. Peningkatan jumlah petugas dan peningkatan kesadaran masyarakat perlu ditingkatkan lagi. Perusahaan harus bertanggung jawab atas kecelakaan jika mereka lalai melaksanakan kewajiban keselamatan. / Trucking plays an important role in Indonesia. More than 91% of shipments use this mode. However, traffic accidents involving trucks rank second after motorcycles. Trucking companies must create, maintain, and implement Safety Management System of Public Transport Company (SMK-PAU) following regulations. However, few companies comply, which is thought to cause high accident rates. Policy implementation theory is used to maximize the application of regulations to reduce accident rates. This study aims to overcome the SMK-PAU inconsistencies in trucking companies to create transportation safety, increase competitive advantage, and develop SMK-PAU based on the Minister of Transportation Regulation Number 85 of 2018, which is more efficient and effective. The research method is empirical normative legal research and is qualitative. The data used are primary data from direct interviews (structured or unstructured) and secondary data through literature studies to obtain relevant results (laws, court decisions, and others). The regulatory and contextual approaches are used in analyzing the data. Not all companies understand SMK-PAU adequately due to a lack of competence, especially small companies that do not have resources, time, and competence. Not all companies implement the ten elements of SMK-PAU. However, companies believe in increasing competitiveness by reducing accidents. The implementation of SMK-PAU has not been optimal due to the licensing complexity. Coordination between institutions needs to be improved because it hinders the implementation of SMK-PAU. In addition, the number of policy implementers is inadequate. Strengthening sanctions against companies can increase the effectiveness of the implementation of SMK-PAU. The implementation of SMK-PAU can reduce accidents in goods transportation. The government needs to improve coordination between institutions by optimizing the role of the Traffic and Road Transportation Forum to maximize the implementation of this policy. SMK-PAU must be applied to other permits that use trucks. Increasing the number of officers and increasing public awareness needs to be improved again. Companies must be responsible for accidents if they neglect safety obligations.
