Abstract

The dynamic landscape of public transportation in Ambon City has faced significant challenges due to the emergence of online transportation services. This study investigates the normative conflicts arising from the coexistence of traditional public transport (angkot) and online transportation platforms, highlighting the legal, social, and economic implications. Ambon City's regulatory framework, grounded in Local Regulation No. 5 of 2011, is analyzed alongside national laws, such as the Traffic and Road Transport Act (Law No. 22 of 2009) and the Ministry of Transportation's regulations. The normative discrepancies stem from the lack of alignment between local and national laws, causing disputes between angkot drivers and online transport operators. Using Hans Kelsen's theory of normative hierarchy and Aristotle's distributive justice theory, this study reveals the critical need for a harmonized regulatory approach. Field interviews with stakeholders, including transportation authorities, angkot associations, and online transport representatives, underscore the urgency of addressing these conflicts. The research concludes with recommendations for inclusive policies that ensure fair competition, protect livelihoods, and promote sustainable urban mobility. By resolving these normative conflicts, Ambon can establish a more equitable and efficient transportation system, reflecting the evolving demands of its citizens. / Dinamika transportasi publik di Kota Ambon menghadapi tantangan signifikan akibat kemunculan layanan transportasi online. Penelitian ini mengkaji konflik normatif yang timbul dari keberadaan bersama antara angkutan umum tradisional (angkot) dan platform transportasi online, dengan menyoroti implikasi hukum, sosial, dan ekonomi. Kerangka regulasi Kota Ambon, yang didasarkan pada Peraturan Daerah Nomor 5 Tahun 2011, dianalisis bersama dengan peraturan nasional, seperti Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan serta peraturan dari Kementerian Perhubungan. Ketidaksesuaian norma muncul karena kurangnya keselarasan antara peraturan lokal dan nasional, sehingga memicu perselisihan antara pengemudi angkot dan operator transportasi online. Dengan menggunakan teori hierarki norma hukum dari Hans Kelsen dan teori keadilan distributif Aristoteles, penelitian ini mengungkapkan perlunya pendekatan regulasi yang harmonis. Wawancara lapangan dengan para pemangku kepentingan, termasuk otoritas transportasi, asosiasi angkot, dan perwakilan transportasi online, menekankan urgensi untuk menangani konflik ini. Penelitian ini menyimpulkan dengan rekomendasi kebijakan inklusif yang memastikan persaingan yang adil, melindungi mata pencaharian, dan mendorong mobilitas perkotaan yang berkelanjutan. Dengan menyelesaikan konflik normatif ini, Kota Ambon dapat membangun sistem transportasi yang lebih adil dan efisien yang mencerminkan kebutuhan masyarakat yang terus berkembang.
