Abstract
The Indonesian government mandates the issuance of land title certificates as legal proof of ownership to prevent disputes and ensure legal certainty in land
ownership. However, the issuance of ownership certificates for marine areas,
particularly in Teluk Genteng, presents significant legal and environmental
challenges. This practice contradicts the foundational principles of land law, which limit property rights to land-based territories, excluding marine environments. Unlike land, marine areas, such as the coral reef zones in Teluk Genteng, hold immense ecological value and are designated as protected areas to conserve biodiversity. These areas should function as common property resources, accessible to all, rather than being privatized through the issuance of ownership certificates. This approach violates several key legal frameworks in Indonesia, including the Basic Agrarian Law (UUPA), which outlines the scope of land rights, Government Regulation No. 18 of 2021 on Land Management and Rights (PP 18/2021), and Law No. 26 of 2007 on Spatial Planning. These laws collectively emphasize the distinct treatment of land and marine resources, with marine zones governed as public domains. By issuing certificates for marine territories, the National Land Office (BPN) not only disregards these legal boundaries but also risks creating legal uncertainty. Furthermore, such actions can undermine public trust, disrupt social equity, and damage sensitive ecosystems critical to local livelihoods and environmental sustainability. To address these issues, it is imperative that ownership certificates for marine areas in Teluk Genteng be revoked. Such a measure would reaffirm the legal principle that land rights apply solely to terrestrial environments and not to marine territories. This action would align administrative practices with the established legal framework and support the sustainable management of marine resources. This approach not only safeguards the ecological integrity of the marine environment but also contributes to long-term economic and environmental sustainability. Moreover, safeguarding marine areas as open-access resources ensures equitable access for all stakeholders while preserving their ecological and economic value for future generations
