Abstract

Penelitian ini membahas tentang kepastian hukum atas akta perjanjian pengikatan jual beli dan surat kuasa jual sebagai dasar utang-piutang yang dibuat di hadapan notaris, adapun permasalahan dalam penelitian ini adalah kepastian hukum dan akibat atas akta perjanjian pengikatan jual beli dan surat kuasa jual sebagai dasar utang-piutang yang dibuat di hadapan notaris pada Putusan Pengadilan Tinggi Kupang Nomor 38/PDT/2020/PT KPG. Metode penelitian yang digunakan adalah penelitian hukum normatif, dengan sumber data sekunder, yaitu merupakan sumber data melalui dokumen-dokumen dan penelitian kepustakaan yaitu sumber hukum sekunder, teknik perolehan data yaitu melalui studi dokumen yang dilakukan dengan cara mengidentifikasi dan menginventarisasi buku-buku teori tentang hukum, majalah hukum, jurnal-jurnal hukum dan juga bahan-bahan kuliah serta peraturan-peraturan tentang wanprestasi serta dasar-dasar gugatan, kemudian pendekatan penelitian dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual, serta teknik analisa data dilakukan yaitu metode deskriptif kualitatif, yaitu penelitian yang mengacu pada norma hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan serta norma-norma yang berkembang dalam kehidupan masyarakat. Hasil penelitian menunjukkan bahwa kepastian hukum atas akta perjanjian pengikatan jual beli dan surat kuasa jual sebagai dasar utang-piutang yang dibuat di hadapan notaris pada Putusan Nomor 38/PDT/2020/PT KPG, ditemukan suatu sebab yang terlarang sehingga tidak mempunyai kekuatan hukum, karena bentuk kuasa mutlak tidak dapat dibenarkan serta ditemukan ketidakpatutan dan akibat hukum atas akta perjanjian pengikatan jual beli dan surat kuasa tersebut apabila tetap dilakukan transaksi jual beli maka dapat dinyatakan batal demi hukum ataupun keadaan kembali seperti semula yaitu hanya sebatas hubungan utang-piutang. Dalam hal ini, tidak serta merta menghapuskan perjanjian utang-piutang yang terlebih dahulu lahir. Kesimpulan dalam melakukan sebuah perjanjian diharapkan dapat memberikan keterangan secara transparan dan jujur, agar tidak merugikan kepentingan para pihak yang mengakibatkan batalnya perjanjian./This study discusses the legal certainty of the deed of sale and purchase agreement and power of attorney as the basis for debts made before a notary, the problem in this study is the legal certainty and consequences of the deed of sale and purchase agreement and power of attorney as the basis for debts made before a notary in the Kupang High Court Decision Number 38/PDT/2020/PT KPG. The research method used is normative legal research, with secondary data sources, namely data sources through documents and library research, namely secondary legal sources, data acquisition techniques, namely through document studies carried out by identifying and inventorying theoretical books on law, law magazines, law journals and also lecture materials and regulations on default and the basis for lawsuits, then the research approach with a statutory approach, case approach, and conceptual approach, and data analysis techniques are carried out, namely qualitative descriptive methods, namely research that refers to legal norms contained in laws and court decisions and norms that develop in community life. The results of the study indicate that the legal certainty of the deed of sale and purchase agreement and power of attorney as the basis for debts made before a notary in Decision Number 38/PDT/2020/PT KPG, found a prohibited cause so that it has no legal force, because the form of absolute power cannot be justified and there was impropriety and legal consequences for the deed of sale and purchase agreement and power of attorney if the sale and purchase transaction is still carried out, it can be declared null and void or the situation returns to its original state, namely only a debt-receivable relationship. In this case, it does not immediately eliminate the debt-receivable agreement that was previously born. The conclusion in making an agreement is expected to provide information transparently and honestly, so as not to harm the interests of the parties which results in the cancellation of the agreement.
