Abstract
Penelitian ini menganalisis pengaturan doktrin dilusi merek terkait merek terkenal berdasarkan Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, serta putusan pengadilan terkait sengketa dilusi merek di Indonesia. Dengan menggunakan metode penelitian hukum normatif, kajian ini menerapkan pendekatan perundang-undangan untuk menelaah kebijakan Direktorat Jenderal Kekayaan Intelektual (DJKI) dalam menilai merek terkenal, serta pendekatan konseptual untuk mengevaluasi dampak ekonomi perlindungan merek terhadap persaingan pasar. Kajian ini membahas kasus-kasus dilusi merek, termasuk sengketa PT Garuda Tasco dengan merek PB, PT Sumatra Tobacco dengan merek yang menyerupai Starbucks, dan pihak lain yang mencoba mendaftarkan merek serupa dengan Watsons, di mana pengadilan membatalkan pendaftaran merek tersebut dengan alasan itikad tidak baik dan dilusi merek. Penelitian ini menyimpulkan bahwa sistem hukum merek di Indonesia, yang mengutamakan prinsip "first-to-file," sering disalahgunakan oleh pihak-pihak dengan itikad tidak baik, sehingga mengakibatkan proses hukum yang berlarut-larut bagi pemilik merek terkenal. Oleh karena itu, disarankan untuk memperkuat pengawasan DJKI dan memberikan edukasi kepada pelaku usaha mengenai pentingnya pendaftaran merek sejak dini. Selain itu, perlu dipertimbangkan adopsi sistem "first-to-use" sebagai alternatif untuk memberikan perlindungan yang lebih efektif bagi merek terkenal. / This study analyzes the regulation of the trademark dilution doctrine concerning well-known marks under Law No. 20 of 2016 on Marks and Geographical Indications, as well as judicial decisions related to trademark dilution disputes in Indonesia. Utilizing a normative legal research methodology, this study employs a statute approach to examine the policies of the Directorate General of Intellectual Property (DJKI) in assessing well-known marks, and a conceptual approach to evaluate the economic implications of trademark protection on market competition. The study examines trademark dilution cases, including PT Garuda Tasco with the PB mark, PT Sumatra Tobacco with a mark resembling Starbucks, and other entities attempting to register marks similar to Watsons, where the court annulled the trademark registration based on bad faith and trademark dilution. The study concludes that Indonesia's trademark legal system, which prioritizes the "first to file" principle, is often exploited by parties with bad faith, resulting in prolonged legal processes for owners of well-known marks. Therefore, it is recommended to strengthen DJKI's oversight and educate business actors on the importance of early trademark registration, as well as to consider the adoption of the "first to use" system.
