Abstract
Tesis ini membahas terbitnya Surat Edaran Mahkamah Agung (SEMA) No. 3 Tahun 2023 yang mengatur bahwa pengembang (developer) tidak dapat dipailitkan. Penelitian ini merupakan penelitian Normatif Empiris yang bertujuan untuk menganalisis asas pembuktian sederhana dalam Penundaan Kewajiban Pembayaran Utang (PKPU) terhadap developer serta mengkaji Pertimbangan Hakim dalam menerapkan asas pembuktian sederhana pada Putusan Pengadilan No. 84/Pdt.Sus-PKPU/2023/PN Niaga Sby. Metode penelitian yang digunakan adalah metode normatif empiris dengan pendekatan perundang-undangan dan pendekatan kasus. Data diperoleh melalui studi kepustakaan dan dianalisis menggunakan metode deskriptif analisis. Hasil penelitian menunjukkan bahwa majelis hakim menolak permohonan PKPU yang diajukan oleh konsumen terhadap developer. Putusan tersebut didasarkan pada pandangan bahwa surat pemesanan unit rumah tidak dapat dijadikan bukti adanya utang yang wajib dipenuhi oleh developer. Namun, jika developer tidak menyerahkan unit rumah kepada pembeli, kewajiban tersebut dapat dinilai dengan uang dan dikategorikan sebagai utang. Dengan demikian, hal ini memenuhi ketentuan Pasal 2 ayat (1) jo Pasal 8 ayat (4) Undang-Undang No. 37 Tahun 2004 tentang Kepailitan dan PKPU.
/ This thesis discusses the publication of Supreme Court Circular Letter (SEMA) No. 3 of 2023 which regulates that developers cannot be bankrupted. This research is an Empirical Normative research which aims to analyze the principle of simple proof in the Postponement of Debt Payment Obligations (PKPU) for developers and examine the Judge's Considerations in applying the principle of simple proof in Court Decision No. 84/Pdt.Sus-PKPU/2023/PN Niaga Sby. The research method used is an empirical normative method with a statutory approach and a case approach.
Data was obtained through literature study and analyzed using descriptive analysis methods. The research results show that the panel of judges rejected the PKPU application submitted by the consumer against the developer. This decision was based on the view that the housing unit order letter cannot be used as proof of a debt that the developer must fulfill. However, if the developer does not hand over the housing unit to the buyer, this obligation can be assessed in money and categorized as debt. Thus, this fulfills the provisions of Article 2 paragraph (1) in conjunction with Article 8 paragraph (4) of Law no. 37 of 2004 concerning Bankruptcy and PKPU
