Abstract
Penelitian berjudul “Urgensi Regulasi Pemanfaatan Kecerdasan Artifisial di Indonesia” ini dilatarbelakangi oleh pesatnya perkembangan teknologi kecerdasan artifisial (AI) dan dampak signifikan yang ditimbulkannya terhadap berbagai aspek kehidupan masyarakat. Sebagai negara hukum, Indonesia menghadapi tantangan dalam memastikan pemanfaatan AI mendukung pembangunan nasional sekaligus melindungi hak individu, privasi, dan kepentingan publik. Namun, ketiadaan regulasi khusus terkait AI menimbulkan risiko penyalahgunaan teknologi, seperti deepfake dan pelanggaran privasi, yang semakin marak terjadi.
Penelitian ini membahas dua isu utama, yaitu ketersediaan regulasi AI di Indonesia dan efektivitas regulasi yang ada dalam mengatur penggunaan AI secara adil dan tepat. Penelitian ini bertujuan untuk mengevaluasi kerangka regulasi AI yang ada saat ini, menganalisis efektivitasnya, serta memberikan rekomendasi untuk pengembangan kebijakan hukum yang relevan.
Penelitian ini menggunakan metode yuridis normatif yang diduking dengan yuridis empiris, dengan menerapkan teori efektivitas hukum dan kepastian hukum. Data dikumpulkan melalui studi literatur dan wawancara dengan para pemangku kepentingan terkait. Hasil penelitian menunjukkan bahwa regulasi yang ada, seperti Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) dan Undang-Undang Perlindungan Data Pribadi (UU PDP), belum memadai untuk mengatur aspek-aspek spesifik AI. Surat Edaran Menteri Komunikasi dan Informatika Nomor 9 Tahun 2023 tentang Etika AI juga tidak memiliki kekuatan hukum yang mengikat. Regulasi yang efektif diperlukan untuk memastikan kepastian hukum, melindungi hak-hak masyarakat, dan mendorong inovasi yang bertanggung jawab.
Penelitian ini menyimpulkan bahwa regulasi khusus terkait AI yang mengadopsi prinsip inklusivitas, keamanan, transparansi, dan akuntabilitas sangat diperlukan. Regulasi ini diharapkan mampu memberikan landasan hukum yang kuat untuk menghadapi tantangan terkait AI di era digital. / This study, titled "The Urgency of Artificial Intelligence Regulation in Indonesia," is motivated by the rapid development of artificial intelligence (AI) technology and its significant impact on various aspects of society. As a rule-of-law state, Indonesia faces challenges in ensuring that the utilization of AI supports national development while safeguarding individual rights, privacy, and public interests. However, the absence of specific AI regulations poses risks of technological misuse, such as deepfake creation and privacy violations, which are becoming increasingly prevalent.
This research addresses two main issues: the availability of AI regulations in Indonesia and the effectiveness of existing regulations in governing AI usage fairly and appropriately. The study aims to evaluate the current AI regulatory framework, analyze its effectiveness, and provide recommendations for the development of relevant legal policies.
This research employs a normative juridical method supported by an empirical juridical approach, applying the theories of legal effectiveness and legal certainty. Data were gathered through literature studies and interviews with relevant stakeholders. The findings indicate that existing regulations, such as the Electronic Information and Transactions Law (UU ITE) and the Personal Data Protection Law (UU PDP), are insufficient to regulate the specific aspects of AI. The Circular Letter of the Minister of Communication and Informatics Number 9 of 2023 on AI Ethics also lacks binding legal authority. Effective regulation is needed to ensure legal certainty, protect public rights, and promote responsible innovation.
This study concludes that specific AI regulations incorporating principles of inclusivity, security, transparency, and accountability are essential. Such regulations are expected to provide a robust legal foundation to address AI-related challenges in the digital era.
