Abstract

The Republic of Indonesia, as a country based on law that upholds the supremacy of the 1945 Constitution, has established traffic regulations to create safe and comfortable driving. Transportation continues to develop along with technological advances and community needs. However, the increase in accidents due to traffic violations, such as reckless operation of open-back vehicles, has caused material and immaterial losses and public unrest. Data shows a high number of accidents, with the main factors being negligence and violations of the law. The government is expected to strengthen law enforcement and road user protection policies to reduce the risk of accidents, improve the quality of road infrastructure, and ensure the implementation of appropriate transportation regulations in order to achieve order and comfort for the community. This study uses a normative-empirical research method. The findings of this study are as follows: First, the implementation of traffic laws and regulations in this country has not been effective. Only 40% of traffic accident victims receive mandatory accident compensation, while the remaining 60% do not receive accident compensation. This is because the community does not understand what their rights and obligations are so that the community suffers losses and becomes victims. Second, legal certainty related to traffic accidents is a shared responsibility. Various efforts have been made by law enforcement officers to reduce the number of traffic accidents in Tangerang City, such as conducting joint operations and implementing regulations. The joint operations that have been carried out are a process of the authorities' efforts to reduce traffic accidents caused by open-load vehicles. The lack of concern from the company that provides the vehicle to minors is certainly a violation of traffic. Violation of operating hours that occurs is an act of violation by the driver and company who only care about a group of people. Of the many vehicles passing through Tangerang City, it is a slight obstacle for the Police due to the lack of Human Resources (HR) owned by each Polres. Although there are still various challenges such as high vehicle volumes and limited human resources. In addition, companies and drivers are required to comply with existing regulations in order to minimize the risk of accidents on the Tangerang City highway.
