Abstract
The implementation of electronic signatures (e-signatures) has become one of the key
digital innovations offering efficiency and security across various legal services.
Fundamentally, the validity of e-signatures is recognized under legal provisions such
as Law No. 1/2024 on the Second Amendment to Law No. 11/2008 on Electronic
Information and Transactions (ITE), Government Regulation No. 71/2019 on
Electronic Systems and Transactions (PSTE), and Ministerial Regulation of ATR/BPN
No. 3/2019 on the Implementation of Electronic Signatures. However, these provisions
exclude the use of e-signatures for signing authentic deeds by notaries. This study
analyzes the regulations governing e-signatures and identifies the obstacles in their
application within notarial practices as a means of safeguarding digital innovation in
Indonesia. The research employs a normative-empirical method with a legislative
approach. The findings reveal that the implementation of e-signatures is currently
inapplicable to authentic notarial deeds due to regulatory exceptions. Nevertheless,
digital innovation remains viable through the digital storage of deed backups, which
is deemed more realistic for enhancing security and efficiency in maintaining deed
integrity while mitigating risks of damage or loss. This study recommends regulatory
harmonization to support digital transformation in notarial practices in Indonesia. / Penerapan tanda tangan elektronik (e-signature) telah menjadi salah satu inovasi digital
yang menawarkan efisiensi dan keamanan dalam berbagai aspek layanan hukum. Pada
dasarnya, e-signature telah diakui keabsahannya berdasarkan ketentuan perundangundangan
dalam UU 1/2024 tentang Perubahan Kedua atas UU 11/2008 tentang ITE,
PP 71/2019 tentang PSTE, dan Permen ATR/BPN No. 3/2019 tentang Penerapan
Tanda Tangan Elektronik. Namun, hal ini tidak berlaku untuk penandatanganan akta
otentik pada notaris. Penelitian ini menganalisis regulasi yang mengatur serta
mengidentifikasi hambatan dalam penerapan e-signature pada praktik kenotariatan
sebagai bentuk pengamanan inovasi digital di Indonesia. Metode penelitian yang
digunakan adalah normatif empiris dengan pendekatan perundang-undangan. Hasil
penelitian menunjukkan bahwa penerapan e-signature belum dapat diterapkan pada
akta otentik notaris karena adanya pengecualian regulasi. Namun, inovasi digital tetap
dapat dilakukan melalui penyimpanan cadangan akta secara digital, yang dinilai lebih
realistis untuk meningkatkan keamanan dan efisiensi dalam menjaga keutuhan akta,
sekaligus mengurangi risiko kerusakan atau kehilangan dokumen. Penelitian ini
menyarankan agar harmonisasi regulasi dilakukan untuk mendukung transformasi
digital dalam praktik kenotariatan di Indonesia.
