Abstract

Uneven and unintegrated land administration, along with the large number of uncertified land plots in Indonesia, are major contributing factors to the rise of land-related crimes such as document forgery and duplication. These crimes often result in legal uncertainty and injustice for rightful landowners. To address these challenges, the implementation of Electronic Certificates (E-Certificates) has emerged as a promising solution to mitigate issues arising from land-related crimes. E-Certificates represent a digital form of land documentation, expected to mitigate issues stemming from these crimes and bring effectiveness to land registration processes. This study aims to assess the effectiveness of E-Certificates in land registration and to explore optimal methods for implementing these certificates. The research employs a Normative juridical method, or legal literature research, to examine relevant laws and regulations. E-Certificates enable more efficient and secure use of electronic documents, simplifying the entire land registration process. By digitizing land records, the process becomes faster and less costly, improving accessibility and transparency for landowners. The study also examines Regulation Number 3 of 2023 issued by the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency, which governs the issuance of electronic documents in land registration. This regulation establishes critical standards for E-Certificates, including robust security measures, accurate data verification, and seamless system integration to maintain the authenticity and reliability of electronic land documents. These measures are designed to combat document manipulation and forgery, key factors enabling land-related crimes. By implementing E-Certificates, the efficiency of land registration is expected to increase significantly, closing legal loopholes previously exploited by these illegal activities. The digitalization of land records allows for stricter monitoring and reduces the risk of data fraud and manipulation. This study emphasizes that E-Certificates can play a transformative role in Indonesia's land administration by curbing illicit activities, ensuring transparency, and enhancing legal certainty for landowners.
