Abstract
Adanya polemik yang ditimbulkan antara penyedia layanan, yakni online travel agent (OTA) penginapan dengan konsumen terkait klausula baku masih sering terjadi. Kondisi demikian dikarenakan posisi yang tidak seimbang yang ditimbulkan klausula baku antara konsumen dengan OTA, yang kemudian merugikan pihak konsumen. Oleh karena itu, penting untuk mengetahui perlindungan bagi konsumen dan bentuk pertanggungjawaban pelaku usaha yaitu online travel agent (OTA). Penelitian ini menggunakan jenis penelitian yuridis normatif. Data yang digunakan terdiri dari data primer dan data sekunder, yang diperoleh menggunakan metode pengumpulan studi pustaka. Pendekatan penelitian menggunakan pendekatan terhadap asas hukum dan pendekatan sistematika hukum. Analisis data yang dilakukan adalah analisis deduktif. Hasil penelitian menjelaskan bahwa perlindungan hukum terhadap konsumen pengguna layanan pemesanan tempat penginapan melalui OTA telah dijelaskan secara tegas dalam UUPK, tepatnya pada Pasal 18 yang menerangkan tentang tidak diperbolehkannya perihal yang dicantumkan dalam klausula baku yang digunakan oleh OTA yang dapat merugikan konsumen. Klausula baku seringkali mengandung isi perjanjian yang tidak sesuai dengan Pasal 18 UUPK, yang dalam Pasal 1320 KUHPer klausula baku yang ditawarkan oleh OTA dapat batal demi hukum. Bentuk
pertanggungjawaban OTA sebagai pelaku usaha terhadap konsumen yang dirugikan karena klausula baku yang ditawarkan adalah memberikan ganti rugi kepada konsumen sebagaimana dijelaskan dalam Pasal 19 UUPK dan Pasal 1365 KUHPer. Ganti rugi dapat berupa material dan non material. Apabila memperhatikan UU ITE Pasal 28 ayat (1) jo Pasal 45A ayat (1) UU 1/2024, OTA dapat dipidana dengan penjara maksimal 6 tahun dan denda maksimal Rp1 miliar karena melakukan penipuan online. / The polemics that arise between service providers, namely online travel agents (OTA) accommodation with consumers regarding standard clauses still often occur. This condition is due to the unbalanced position caused by standard clauses between consumers and OTA, which then harms consumers. Therefore, it is important to know the protection for consumers and the form of responsibility of business actors, namely online travel agents (OTA). This study uses a normative legal research type. The data used consists of primary data and secondary data, which are obtained using the library study collection method. The research approach uses an approach to legal principles and a legal systematic approach. The data analysis carried out is deductive analysis. The results of the study explain Legal protection for consumers who use accommodation
booking services through OTA has been clearly explained in UUPK, specifically in Article 18 which explains that matters listed in the standard clauses used by OTAs that can harm consumers are not permitted. Standard clauses often contain agreements that are not in accordance with Article 18 of UUPK, which in Article 1320 of the Civil Code, standard clauses offered by OTAs can be canceled by law. The form of OTA's responsibility as a business actor towards consumers who are harmed due to the standard clauses offered is to provide compensation to consumers as explained in Article 19 of the UUPK and Article 1365 of the KUHPer. Compensation can be material and non-material. If we pay attention to the ITE Law Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of Law 1/2024, OTA can be punished with a maximum imprisonment of 6 years and a maximum fine of IDR 1 billion for committing online fraud.
