Abstract

Kehadiran pasar digital yang merujuk pada lingkungan bisnis dan perdagangan berfokus pada penggunaan teknologi digital dan internet untuk memfasilitasi transaksi, interaksi dan komunikasi. Persaingan usaha harus dilakukan secara sehat untuk mencegah timbulnya praktek monopoli atau persaingan usaha tidak sehat. Penelitian ini bertujuan untuk mengetahui pengaturan hukum persaingan usaha tidak sehat yang ditimbulkan pasar digital menurut hukum yang berlaku di Indonesia dan dampak atau implikasi penggunaan Tiktok terhadap UMKM Indonesia menurut Undang-Undang No. 5 Tahun 1999. Metode Penelitian ini menggunakan yuridis normatif, yang dilakukan dengan cara melakukan penelitian kepustakaan yang diperoleh dari data sekunder. Hasil penelitian menunjukkan bahwa pengaturan hukum persaingan usaha tidak sehat yang ditimbulkan pasar digital menurut hukum yang berlaku di Indonesia terdapat dalam Undang-Undang No. 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat dan Undang-Undang Nomor 7 Tahun 2014 Tentang Perdagangan mengatur kegiatan perdagangan di Indonesia. Perdagangan Menggunakan Sistem Elektronik (PMSE). Selanjutnya dampak atau implikasi penggunaan Tiktok terhadap UMKM Indonesia menurut Undang-Undang No. 5 Tahun 1999 adalah adanya dugaan praktik jual beli yang dilakukan oleh platform tersebut dengan menetapkan harga produk terlalu rendah dibandingkan harga pasar untuk menghilangkan persaingan. / The presence of a digital market that refers to the business and trade environment focuses on the use of digital technology and the internet to facilitate transactions, interactions and communications. Business competition must be carried out in a healthy manner to prevent the emergence of monopolistic practices or unfair business competition. This study aims to determine the legal regulations for unfair business competition caused by the digital market according to applicable laws in Indonesia and the impact or implications of the use of TikTok on Indonesian MSMEs according to "Law No. 5 of 1999." This research method uses normative juridical, which is carried out by conducting library research obtained from secondary data. The results of the study indicate that the legal regulations for unfair business competition caused by the digital market according to applicable laws in Indonesia are contained in Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition and Law Number 7 of 2014 concerning Trade regulates trade activities in Indonesia. Trading Using Electronic Systems (PMSE). Furthermore, the impact or implications of the use of TikTok on Indonesian MSMEs according to Law No. 5 of 1999 was the alleged buying and selling practices carried out by the platform by setting product prices too low compared to market prices to eliminate competition.
