ABSTRAK Penelitian ini memiliki dua tujuan yaitu untuk mengetahui berbagai hambatan yang muncul dalam implementasi asas praduga tidak bersalah dalam proses pemeriksaan di tingkat penyidikan dan juga untuk mengetahui seberapa Efektifkah Asas Praduga Tak Bersalah mencegah kekeliruan informasi yang dapat mengakibatkan terjadinya peradilan sepihak oleh pers, sehingga tidak menggiring masyarakat untuk memiliki keyakinan yang belum dibuktikan oleh pengadilan. Metode penelitian dalam skripsi ini menggunakan jenis metode penelitian hukum yuridis normatif, yang berfokus pada penelitian terhadap materi-materi yang diperoleh dari sumber-sumber pustaka, seperti buku, jurnal, majalah, surat kabar, dan lain sebagainya, yang mana dari sumber-sumber tersebut akan dianalisa secara mendalam hingga mendapatkan hasil penelitian serta kesimpulan dari penelitian ini. Hasil Penelitian dalam skripsi ini menunjukkan bahwa ada beberapa hal yang perlu ditingkatkan guna mencapai tujuan dari penelitian ini, yakni sistem pengawasan dan kontrol dari instansi yang perlu peningkatan efektivitas agar tidak ada pelanggaran Hak Azasi Manusia yang terjadi di lapangan. Dalam menegakkan supremasi hukum tentunya harus dibarengi dengan kerja sama dan sikap kooperatif dari berbagai pihak yakni para penegak hukum, masyarakat, pers dan pemerintah. Aturan perundang-undangan juga merupakan dasar penting pelaksanaan asas praduga tak bersalah, yang mana aturan harus dapat ditafsir dengan jelas tanpa adanya multitafsir dari berbagai pihak mengenai pengaturan undang-undang tersebut, sehingga tidak terjadinya peradilan sepihak oleh pers. Kata Kunci : Asas Praduga Tak Bersalah, Peradilan Sepihak Oleh Pers, Hak Azasi Manusia / ABSTRACT This research has two objectives, namely to find out the various obstacles that arise in the implementation of the presumption of innocence in the examination process at the investigative level and also to find out how effective the Presumption of Innocence is in preventing misinformation that can lead to trial by press, so as not to lead the public to have beliefs that have not been proven by a court of law. The research method in this thesis uses a type of normative juridical research method, which focuses on research on materials obtained from library sources, such as books, journals, magazines, newspapers, and so on, which of these sources will be analyzed in depth to obtain research results and conclusions from this study. The research results in this thesis indicate that there are several things that need to be improved in order to achieve the objectives of this research, namely the monitoring and control system of agencies that need to improve effectiveness so that human rights violations do not occur in the field. In upholding the rule of law, of course, it must be accompanied by cooperation and cooperative attitude from various parties, namely law enforcers, the public, the press and the government. The rules of law and regulations are also an important basis for the implementation of the presumption of innocence, in which the rules must be interpreted clearly without multiple interpretations from various parties regarding the regulation of the law, so that "Trial By Press" does not occur.
