Abstract

Upah adalah hak yang wajib diberikan oleh pengusaha kepada pekerja/buruh. Perlindungan hukum terhadap upah pekerja/buruh merupakan salah satu aspek penting dalam menjaga hubungan industrial. Namun, dalam praktiknya, banyak perusahaan yang secara sepihak melakukan penurunan upah tanpa perubahan beban kerja serta tanpa adanya kesepakatan antara pekerja/buruh dengan pengusaha. Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan penurunan upah tanpa perubahan beban kerja dan perlindungan hukum bagi pekerja yang mengalami penurunan upah tanpa perubahan beban kerja berdasarkan hukum positif ketenagakerjaan di Indonesia. Penelitian ini menggunakan metode penelitian hukum deskriptif analisis. Jenis penelitian ini menggunakan penelitian hukum normatif. Data yang digunakan dalam penelitian ini adalah data sekunder yang mencakup bahan hukum primer, sekunder dan tersier. Cara perolehan data melalui studi kepustakaan. Jenis pendekatan yang digunakan adalah pendekatan penelitian terhadap asas-asas hukum. Sifat Analisa data yang diterapkan adalah logika deduksi. Hasil dari penelitian ini menunjukkan bahwa penurunan upah tanpa perubahan beban kerja hanya dapat dilakukan apabilah telah mencapai kesepakatan antara pekerja/buruh. Perlindungan hukum bagi pekerja yang mengalami penurunan upah tanpa perubahan beban kerja dan tanpa adanya kesepakatan antara pekerja/buruh dengan pengusaha, pekerja dapat mengajukan Gugatan Perselisihan Hak kepada Pengadilan Hubungan Industrial (PHI) / Wages are a right that must be provided by employers to workers/laborers. Legal protection for workers' wages is one of the key aspects in maintaining industrial relations. However, in practice, many companies unilaterally reduce wages without changes in job duties and without any agreement between the workers/laborers and the employers. This research aims to understand the regulations regarding wage reductions without changes in job duties and the legal protection available for workers who experience wage reductions without job changes under Indonesia’s positive labor law. This study employs a descriptive analytical legal research method. The type of research used is normative legal research. The data utilized in this research consists of secondary data, which includes primary, secondary, and tertiary legal materials. Data collection is conducted through literature studies. The approach used in this research is the study of legal principles. The data analysis applied is deductive logic. The results of this research indicate that wage reductions without changes in job duties can only be carried out if an agreement between the worker/laborer and the employer has been reached. Legal protection for workers experiencing wage reductions without changes in job duties and without an agreement between the worker/laborer and the employer allows the worker to file a Rights Dispute Lawsuit with the Industrial Relations Court (PHI)
