Abstract
The need for homeownership is a fundamental necessity for every community. In
its development, a banking product known as Home Ownership Credit ("KPR") has
emerged to meet this need. The KPR process is closely related to the credit
agreement between the creditor (Bank) and the debtor (consumer). After the credit
agreement, under certain conditions, the Power of Attorney to Impose Mortgages
(SKMHT) is processed. The laws regulating SKMHT in Indonesia are found in Law
Number 4 of 1996 concerning Mortgages on Land and Objects Related to Land
("UUHT"), Law Number 8 of 1999 concerning Consumer Protection ("UUPK"),
and Financial Services Authority Regulation Number 22 of 2023 concerning
Consumer and Community Protection in the Financial Services Sector ("POJK").
These three laws are connected to banking practices in credit agreements, where
banks use SKMHT after the credit agreement is signed. The SKMHT process, based
on UUPK and POJK, is prohibited because SKMHT is categorized as a standard
clause in a credit agreement. However, this contradicts the UUHT, which allows
SKMHT as long as it does not violate predefined limits. This disharmony between
laws and their implementing regulations creates issues and legal uncertainty for the
parties involved. This thesis employs normative empirical research methods. The
research questions focus on how SKMHT is regulated under applicable laws and
how legal protection for creditors is addressed in such laws. The conclusion is that
SKMHT is still practiced despite conflicting with UUPK and POJK. The legal
standing of creditors under UUPK and POJK is very weak in the event of future
disputes, necessitating alignment between UUHT, UUPK, and POJK. / Kebutuhan terhadap kepemilikan rumah merupakan kebutuhan pokok setiap
masyarakat, pada perkembangan nya untuk memenuhi kebutuhan kepemilikan
rumah, berkembang suatu produk perbankan yang dikenal dengan Kredit
Kepemilikan Rumah (“KPR”). Dalam proses KPR erat kaitannya dengan perjanjian
kredit yang dilakukan antara kreditur (Bank) dengan debitur (konsumen), pada
proses setelah perjanjian kredit pada kondisi tertentu dilakukan proses surat kuasa
membebankan hak tanggungan (SKMHT). Peraturan perundang-undangan yang
mengatur mengenai SKMHT di Indonesia terdapat dalam Undang-Undang Nomor
4 Tahun 1996 Tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang
Berkaitan Dengan Tanah (“UUHT”), Undang-Undang Nomor 8 Tahun 1999
Tentang Perlindungan Konsumen (“UUPK”), Peraturan Otiritas Jasa Keuangan
Republik Indonesia Nomor 22 Tahun 2023 Tentang Perlindungan Konsumen Dan
Masyarakat di Sektor Jasa Keuangan (“POJK”), yang mana dari ketiga peraturan
perundang-undangan tersebut dikaitkan dengan praktek perbankan dalam
menjalankan perjanjian kredit, pihak bank menggunakan SKMHT setelah
perjanjian kredit ditandatangani. Proses SKMHT tersebut yang berdasarkan UUPK
dan POJK dilarang digunakan dengan alasan SKMHT termasuk dalam kategori
klausula baku dalam suatu perjanjian kredit, namun berbanding terbalik dengan
UUHT yang mana di dalam UUHT pelaksanaan SKMHT tidak dilarang sepanjang
tidak bertentangan dengan batasan yang telah ditentukan. Keadaan disharmoni
diantara undang-undang dan peraturan pelaksananya tersebut menjadi suatu
keadaan yang dapat menciptakan suatu permasalahan yang dapat mewujudkan tidak
adanya kepastian hukum bagi para pihak. Metode penelitian dalam tesis ini
menggunakan normatif empiris. Dengan rumusan masalah bagaimana pengaturan
atas SKMT menurut perundang-undangan yang berlaku dan bagaimana
perlindungan hukum bagi kreditur khususnya dalam peraturan perundangundangan
yang berlaku, dengan kesimpulan SKMHT pada prakteknya masih
digunakan meskipun bertentangan dengan UUPK dan POJK, kedudukan hukum
kreditur berdasarkan UUPK dan POJK sangat lemah apabila dikemudian hari
terjadi sengketa sehingga perlu adanya penyelarasan antara UUHT, UUPK, POJK.
