Abstract
The problem examined in this Thesis is how the procedure for granting bank CREDIT WHICH FIDUCIARY GUARANTEE IS A building THAT STAND ON STATE LAND and how to execute THAT building procedure which is used as a fiduciary ASSET if the Debtor defaults, AND THEN LOOK FOR THE CORRECT ANSWER whether the building that stands on State land can be used as an appropriate guarantee to obtain credit at the Bank. Under the Mortgage Law Number 4 of 1996 guarantees in the form of land can be charge by the Mortgage Law, including buildings, parks, plants and everything that already exists that is an integral part of the land, according to its designation or based on applicable laws and regulations can be considered as a permanent objects, but since the birth and enactment of Law Number 42, 1999 concerning Fiduciary Guarantees contribute an innovation which Assets for movable objects both tangible and intangible and immovable objects, in this case the buildings that cannot be encumbered by the Mortgage Law, remain in the possession of the Fiduciary Giver as a form of paying off debts to the Bank and priority rights to the Bank as the fiduciary recipient of other Creditors. / Masalah yang dikaji dalam Tesis ini adalah bagaimana Tatacara pemberian kredit Bank dengan jaminan bangunan yang dijadikan objek fidusia berdiri diatas tanah Negara serta bagaimana prosedur eksekusi bangunan yang dijadikan objek fidusia tersebut apabila Debitur melakukan wanprestasi. Dan kemudian mencari jawaban apakah bangunan yang berdiri diatas tanah Negara tersebut dapat dijadikan jaminan yang tepat untuk memperoleh kredit di Bank. Berdasarkan Undang-Undang Hak Tanggungan Nomor 4 Tahun 1996 jaminan dalam bentuk tanah dapat dibebankan Hak Tanggungan, dengan demikian termasuk pada bangunan, taman, tanaman dan segala sesuatu yang telah ada yang merupakan satu kesatuan dengan tanah tersebut, yang menurut sifat peruntukannya atau yang berdasarkan Undang-Undang dan peraturan yang berlaku dapat dianggap sebagai benda tetap. Akan tetapi sejak lahir dan diberlakukannya Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia memberikan suatu inovasi dalam dunia jaminan dimana jaminan atas benda bergerak baik yang berwujud maupun tidak berwujud maupun benda tidak bergerak yang dalam hal ini mengenai bangunan yang tidak dapat dibebani Hak Tanggungan tetap berada dalam penguasaan Pemberi Fidusia sebagai bentuk pelunasan utang kepada Bank dan memberikan hak prioritas kepada Bank selaku penerima fidusia terhadap kreditur-kreditur lainnya.
