Abstract

This study examines legal protection and corporate responsibility for workers experiencing a status change from Fixed-Term Contract Workers (PKWT) to Daily Casual Workers (PHL). Employing a normative juridical approach and descriptive analytical research methods, the study analyzes the implementation of Law No. 6 of 2023 and related regulations in safeguarding the rights of workers undergoing employment status transitions. The findings reveal that while a legal framework exists to protect workers' rights, gaps remain in its implementation, particularly regarding the loss of benefits such as BPJS Employment, BPJS Health, paid leave, and access to training after the status change. A case study in Sidoarjo shows that companies often neglect their obligations to uphold workers' fundamental rights after the status change, violating the principle of non-discrimination in labor law. This study recommends strengthening labor inspection systems, developing more comprehensive internal corporate policies, and modernizing service systems to enhance protection for workers undergoing employment status transitions / Penelitian ini mengkaji perlindungan hukum dan tanggung jawab perusahaan terhadap pekerja yang mengalami perubahan status dari Pekerja Perjanjian Kerja Waktu Tertentu (PKWT) menjadi Pekerja Harian Lepas (PHL). Dengan menggunakan pendekatan yuridis normatif dan metode penelitian deskriptif analitis, studi ini menganalisis penerapan Undang-Undang No. 6 Tahun 2023 dan regulasi terkait dalam melindungi hak-hak pekerja yang mengalami transisi status kerja. Hasil penelitian menunjukkan bahwa meskipun terdapat kerangka hukum untuk melindungi hak pekerja, masih terdapat celah dalam pelaksanaannya, terutama terkait hilangnya manfaat seperti BPJS Ketenagakerjaan, BPJS Kesehatan, cuti berbayar, dan akses terhadap pelatihan setelah perubahan status. Studi kasus di Sidoarjo menunjukkan bahwa perusahaan sering mengabaikan kewajibannya untuk menjaga hak-hak fundamental pekerja setelah perubahan status, yang melanggar prinsip non-diskriminasi dalam hukum ketenagakerjaan. Penelitian ini merekomendasikan penguatan sistem pengawasan ketenagakerjaan, pengembangan kebijakan internal perusahaan yang lebih komprehensif, dan modernisasi sistem layanan untuk meningkatkan perlindungan bagi pekerja yang mengalami transisi status kerja
