Abstract
Setelah ditandatanganinya suatu Perjanjian Kredit, sebagai pengaman bagi
terlaksananya pengembalian hutang atau kredit adalah dengan adanya jaminan yang
umumnya berupa Hak Tanggungan. Untuk Hak Tanggungan yang dibebankan pada
suatu HGB, maka hal yang harus selalu diperhatikan adalah bahwa Hak Tanggungan
dapat berakhir apabila HGB telah berakhir masa berlakunya. Namun pelaksanaan
perpanjangan jaminan berupa HGB tidak selamanya lancar dan tanpa hambatan, Penulis
menemukan beberapa hambatan dalam pelaksanaannya. Misalnya saja, terdapat Kantor
Pertanahan setempat tidak dapat melakukan perpanjangan HGB tersebut karena terdapat
ribuan meter persegi tanah di daerah tersebut yang menjadi sengketa. Oleh karena itu,
Penulis melakukan studi yuridis normatif atas permasalahan ini, dan menemukan
kesimpulan bahwa peraturan yang ada di Indonesia kurang melindungi kepentingan
pemegang hak tanggungan karena dengan hapusnya hak atas tanah, maka hak
tanggungan juga terhapuskan. Penulis melihat adanya potensi Bank kehilangan objek
jaminan kredit debitur akibat kurang tegasnya aturan Pemerintah tersebut / When the loan agreement is signed, commonly it will be followed by the mortgage deed.
The Creditors shall remember that the Mortgage could be ended if the Building Rights
is expired. However, the implementation of the Building Rights’ extension is smooth
and without obstacles. Author found several obstacles in its implementation. For
example, the Land Office cannot extend the Building Rights because there are
thousands of square meters of land in the area that are in dispute. Therefore, the Author
conducted a normative juridical studies on this problem, and found the conclusion that
existing regulations in Indonesia do not protect the interests of mortgage rights holders
because with the elimination of land rights, mortgage rights are also eliminated. The
Author sees the potential for banks to lose credit collateral objects due to the lack of
strict government regulations
