Abstract

Penelitian ini bertujuan untuk mengetahui Perlindungan Konsumen Terhadap Penjualan Makanan yang Tidak Sesuai Sertifikat Halal Oleh Badan Penyelenggara Jaminan Produk Halal di Medan. Penelitian ini menggunakan jenis penelitian yang bersifat yuridis normatif empiris dengan cara meneliti peristiwa hukum dalam masyarakat. Penelitian ini mengunakan metode penelitian yuridis normatif dan yuridis empiris dengan meneliti data primer yaitu hasil wawancara dengan pihak-pihak yang terkait dengan Badan Penyelenggara Jaminan Produk Halal di Medan kemudian meneliti data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Metode pengumpulan data penelitian dilakukan melalui buku-buku, jurnal dan artikel yang terkait dengan permasalahan yang sedang diteliti. Jenis pendekatan penelitian yang digunakan ialah pendekatan penelitian kualitatif dengan cara deskripsi, mengumpulkan dan menginterpretasi data primer dan sekunder. Data yang dikumpulkan oleh penulis akan dianalisis dengan menggunakan teknik analisis deskriptif untuk mendapatkan jawaban atas permasalahan. Hasil penelitian menunjukkan bahwa Peran BPJPH (Badan Penyelenggara Jaminan Produk Halal) melindungi Konsumen dalam menjamin kehalalan produk yang dipasarkan adalah BPJH berwenang merumuskan dan menetapkan kebijakan jaminan produk halal, menetapkan norma, standar, prosedur dan kriteria jaminan produk halal, pengawasa produk yang sudah mendapatkan sertifikasi halal, menerbitkan dan mencabut Sertifikat Halal pada produk makanan dan minuman baik yang berasal dari dalam negeri maupun luar negeri. Kemudian melakukan registrasi Sertifikat Halal pada produk luar makanan dan minuman. Tugas uatama BPJH adalah mensertifikasi halal suatu produk yang diajukan pelaku usaha, BPJPH sebagai kordinator jaminan produk halal melakukan sinergi dengan pihak lain yaitu Lembaga Pemeriksa Halal (LPH) dan MUI dalam mensertifikasi suatu produk halal. BPJPH sebagai regulator atas jaminan produk halal juga bertugas menetapkan aturan atau regulasi, menerima dan memverifikasi pengajuan produk yang akan disertifikasi halal dari pelaku usaha (pemilik produk,) dan menerbitkan sertifikat halal beserta label halal Kendala yang dialami BPJPH dalam memberikan sertikasi halal kepada pelaku usaha adalah kendala internal dalam bentuk kendala birokrasi dan kendala atas kinerja BPJPH dan kendala eksternal dalam bentuk kurangnya sosialiasi dan sarana teknologi dan informasi yang kurang memadai./ This research aims to determine consumer protection against the sale of food that does not comply with Halal certificates by the Halal Product Guarantee Organizing Agency in Medan. This research uses a type of research that is empirical normative juridical by examining legal events in society. This study uses normative and empirical legal research methods by examining primary data, namely the results of interviews with parties related to the Halal Product Guarantee Agency in Medan, then examining secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The method of collecting research data is carried out through books, journals and articles related to the problems being studied. The type of research approach used is a qualitative research approach by means of description, collecting and interpreting primary and secondary data. The data collected by the author will be analyzed using descriptive analysis techniques to obtain answers to the problems. The research results show that the role of BPJPH (Halal Product Guarantee Organizing Agency) to protect consumers in guaranteeing the halalness of products being marketed is that BPJH has the authority to formulate and establish halal product guarantee policies, establish norms, standards, procedures and criteria for halal product guarantees, supervise products that have received certification. halal, issuing and revoking Halal Certificates for food and beverage products both from within the country and abroad. Then register for Halal Certificates on non-food and beverage products. BPJH's main task is to certify halal products proposed by business actors. BPJPH as the halal product guarantee coordinator synergizes with other parties, namely the Halal Inspection Institute (LPH) and MUI in certifying halal products. BPJPH as a regulator for halal product guarantees is also tasked with establishing rules or regulations, receiving and verifying applications for products to be certified halal from business actors (product owners) and issuing halal certificates along with halal labels. The obstacles experienced by BPJPH in providing halal certification to business actors are internal obstacles in the form of bureaucratic obstacles and obstacles to BPJPH's performance and external obstacles in the form of lack of socialization and inadequate technological and information facilities.
