Abstract

Penelitian ini membahas analisis perlindungan hukum terhadap pekerja migran Indonesia dalam kontrak kerja pada program Ferienjob di Jerman dengan menganalisa tanggung jawab para pihak dan perlindungan menurut hukum Indonesia. Penulis menggunakan metode penelitian hukum normatif-empiris, penelitian ini menelaah perjanjian kerja yang disepakati para pihak, Undang-Undang Nomor 6 Tahun 2012 tentang Pengesahan Konvensi Internasional Mengenai Perlindungan Hak-Hak Seluruh Pekerja Migran dan Anggota Keluarganya, Undang-Undang Nomor 17 Tahun 2018 tentang Pelindungan Pekerja Migran Indonesia, Peraturan Presiden Nomor 90 Tahun 2019 tentang Badan Pengawas Pekerja Migran Indonesia. Data sekunder yang digunakan terdiri dari bahan hukum primer,sekunder, dan tersier, yang diperoleh dari studi kepustakaan. Data primer yang digunakan diperoleh dengan pertanyaan melalui Google Form. Penelitian ini menemukan bahwa masih kurangnya tanggung jawab dari para pihak karena hanya berdasarkan dua perjanjian yang membangun hubungan hukum. Dimana isi perjanjian lebih melindungi perusahaan pemberi kerja, adanya pihak lain sebagai partner pendidikan yang turut serta memberi informasi kepada PMI, tetapi tidak memilki tanggung jawab karena tidak terikat perjanjian kerja dengan PMI. Melalui penelitian ini juga ditemukan bahwa perlindungan terhadap pekerja migran Indonesia menurut hukum Indonesia sudah diatur namun masih memiliki celah pada badan pengawas yang dimiliki atau BP2MI. Dengan penelitian ini ditinjau dari tinjauan hukum melalui teori perlindungan hukum tenaga kerja, teori hukum ketenagakerjaan, teori kontrak kerja. Memberikan satu pandangan terhadap masalah ketenagakerjaan./This research discusses the analysis of legal protection for Indonesian migrant workers within employment contracts under the Ferienjob program in Germany by examining the responsibilities of the parties involved and the protection provided under Indonesian law. The author employs a normative-empirical legal research method. This study reviews the employment agreements made between the parties, Law Number 6 of 2012 concerning the Ratification of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, Law Number 17 of 2018 on the Protection of Indonesian Migrant Workers, and Presidential Regulation Number 90 of 2019 regarding the Indonesian Migrant Workers Protection Agency. The secondary data used consists of primary, secondary, and tertiary legal materials obtained through library research. The primary data was collected via questions posed through Google Forms. The study finds that there is still a lack of responsibility from the parties involved, as the relationship is based on only two agreements, which primarily favor the employer. Another party, an educational partner, also provides information to the Indonesian migrant workers (PMI) but does not bear responsibility, as it is not bound by an employment agreement with the PMIs. This research also reveals that although legal protection for Indonesian migrant workers is regulated under Indonesian law, there are still gaps in the oversight by the supervisory body, BP2MI. This study provides a legal perspective on the issues of labor protection, labor law theory, and employment contract theory, offering an outlook on labor issues.
