Abstract
Sexual violence is a disturbing crime. Moreover, if sexual violence is committed in
the family, which should be the safest and most comfortable place, where members
protect each other and become the smallest social sphere before they enter the
wider community. This study aims to analyze law enforcement for perpetrators of
sexual violence in the family. To find out law enforcement for perpetrators of sexual
violence in the family and obstacles in handling sexual violence in the family. This
research uses normative legal research with data obtained through literature study.
The approach used in this research is an approach to legal principles and legal
cases. Using qualitative analysis, and conveying conclusions deductively. Using
various sources The results showed that the government has made many regulations
to provide a deterrent effect to the perpetrators. In practice, there is a gap between
the regulations and their implementation by using existing regulations in Indonesia
that are relevant to sexual violence with cases of sexual violence in families that
occur in real life. Various efforts have been made by the government to provide a
deterrent effect for perpetrators of sexual violence. Starting from imprisonment,
fines, restitution, to chemical castration which still reaps many pros and cons from
a human rights perspective. Restitution as an effort to hold the perpetrator
accountable to the victim is not widely applied in the indictment. In this study there
were five cases of sexual violence experienced by people living under the same roof
as the perpetrator and none of them applied restitution. In these five cases, the
sexual violence was also revealed by the victim with the help of others.The victim's
fear, the dominance of the perpetrator, and the community's mixed views between
what the victim experienced was a disgrace and sexual deviant behavior were
common reasons why victims were reluctant to report.
