Abstract
Civil law is one of the laws that regulates inheritance in Indonesia. Fighting
over inheritance occurs a lot and is a case that is often handled in courts. Control
of inherited assets by people other than the legal heirs is also something that is not
uncommon, considering that most of the perpetrators and victims are related, the
rules governing heir groups in civil law need to be paid more attention in handling
inheritance cases. In writing this thesis, the author used the topic of inheritance law
cases originating from court decision number 201/Pdt.G/2019/PN Sby. The
problem formulation used concerns the implementation of civil law rules used by
the Panel of Judges in considering the case. The aim of writing this thesis is to
provide more insight into the proper division of inheritance and the implementation
of existing civil law in Indonesia in handling inheritance cases.
The research methodology used is normative legal research with primary
data originating from the Civil Code. Constitution of 1945, Law Number 1 of 1974,
and Constitutional Court Decision Number 69/PUU-XIII/2015. The topic that the
author takes is the implementation of existing regulations in civil law in the
distribution of inheritance which occurs after the inheritance is opened or after the
Benefactor is declared dead.
However, remembering that inheritance division is the division of the
inheritance of the heir, it is not uncommon to find heirs or the heir's family who
want the inheritance and use inappropriate methods to obtain it. Sometimes, if the
method used is against the law but only causes harm, then the perpetrator or
defendant will be punished because he has committed an unlawful act. Unlawful
Acts are acts that are often found in society related to actions carried out by them
to fulfill their interests by violating the law, but which also cause losses to the victim,
but the losses can only be replaced if there is concrete evidence.
