Abstract
This internship report focuses on consumer protection laws for the tobacco
industry in Indonesia, using PT Tapel Kuda Kencana as a case study. The
internship took place at RSPP Law Firm, a legal consultancy firm in Jakarta
specializing in corporate and consumer protection cases. The main objectives of
this report were to understand the regulation specific to the tobacco industry,
examine the legal framework surrounding consumer protection, assess the
company's compliance with existing regulations, and provide legal opinions to
help align its business practices with the law. This report review key regulations
like the Consumer Protection Act (Law No. 8 of 1999) and Health Law (Law No.
36 of 2009), alongside several government regulations on tobacco products.
Through this internship, I gained firsthand experience in analyzing real-world
legal cases and understanding the complexities of balancing corporate interests
with consumer rights. It also highlighted the crucial role of legal opinions in
bridging gaps between laws and their practical application. This experience not
only deepened my understanding of consumer protection laws but also showed the
importance of proactive legal measures in building trust between companies and
consumers. Through this internship, it can be understood that substantively,
Indonesia does not lack regulations governing the consumption of cigarettes.
There are numerous laws that regulate the production of cigarettes. When the
government imposes a ban on cigarette consumption, it will impact public health.
Over time, cigarette companies require legal opinions regarding consumer
protection, which in practice can include aspects of legality, consumer protection,
and health protection. Most people still do not pay much attention to these
regulations, especially regarding the warning labels on cigarette packs.
Therefore, it is necessary to educate the public about this as an effort by
producers to provide protection through community service programs.
