Abstract

In 2023, Indonesia generated approximately 38,3 million tons of waste, with food waste comprising a significant 39.69%. Sectorally, households and the HORECA (hotels, restaurants, and catering) industry were the largest contributors to food waste. The limited implementation of source reduction strategies and inadequate infrastructure at Waste Sorting and Management Facilities (FPPS) resulted in the disposal of unmanaged food waste in landfills, commonly known as "open dumping". Normatively, Article 44 paragraph 2 of Law No. 18/2008 mandates local governments to close open dumpsites and revitalize them into sanitary landfills since 2013, as landfills are essentially intended for residual waste only. However, the Ministry of Environment and Forestry (KLHK) revealed that out of 271 landfills, approximately 66.81% operate using this method, and 90% of them are overcapacity. This has prompted the implementation of policies prohibiting the disposal of food waste in landfills by West Java Province through Governor's Instruction No. 02/PBLS.04/DLH and Sleman Regency through Circular Letter No. 425 of 2023. Nevertheless, the implementation of these policies in Bandung and Sleman is considered ineffective. Therefore, this research examines these two problems using Lawrence M. Friedman's Legal Systems Theory. A normativeempirical research method was employed. The findings indicate that the implementation of policies to revitalize open dumpsites and prohibit food waste disposal has been hindered by several factors, including weak law enforcement, inadequate FPPS infrastructure, limited funding, and a lack of public awareness of waste management. Consequently, improvements are necessary in four aspects: 1) Legal aspect: implementing a "reward as responsibility" concept to incentivize individuals and the HORECA industry to sort waste; 2) Institutional aspect: improving the suitability of FPPS infrastructure, public education, and partnerships with the private sector; 3) Financial aspect: making waste management a mandatory spending and exploring private sector funding options for landfill revitalization; 4) Technical operational aspect: scheduling separate waste collection and innovating the construction of waste-to-energy power plants.
