Abstract
Pekerja yang menerima upah di bawah ketentuan upah minimum tidak cukup untuk memenuhi hidup yang layak, berarti besaran upah tersebut belum mencerminkan nilai keadilan bagi pekerja. Ada tiga permasalahan yang diajukan dalam penelitian disertasi ini, yakni tentang; (1) pengaturan mengenai pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum di Indonesia saat ini; (2) implementasi pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum; dan (3) pengaturan ideal mengenai pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum berbasis nilai keadilan di Indonesia pada masa mendatang. Untuk menganalis terhadap tiga permasalahan tersebut, menggunakan metode yuridis normatif dengan tiga teori hukum yang digunakan untuk menganalisis yaitu teori pemidanaan, teori sistem hukum Lawrence M Friedman dan teori keadilan bermartabat. Adapun temuan penelitian ini yakni (1) pengaturan mengenai pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum di Indonesia saat secara umum diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-Undang Nomor 6 Tahun 2020 tentang Cipta Kerja. Kebijakan pengupahan secara khusus diatur dalam Peraturan Pemerintah Nomor 36 Tahun 2021 tentang Pengupahan sedangkan Peraturan Pemerintah Nomor 51 Tahun 2023 hanya merubah rumus kenaikan upah minimum yang diatur sebelumnya dalam Peraturan Pemerintah Nomor 36 Tahun 2021. (2) Implementasi pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum di Indonesia masih banyak mengalami persoalan, khususnya masalah perbuatan korporasi karena sifat dan eksistensi korporasi sebagai subyek hukum ini berbeda dengan sifat dan eksistensi manusia (natuurlijke persoon) sebagai subyek hukum. (3) Pengaturan ideal mengenai pertanggungjawaban pidana korporasi yang membayar upah di bawah upah minimum berbasis nilai keadilan di Indonesia pada masa mendatang yaitu (a) jenis pidana yang ideal dijatuhkan kepada korporasi yaitu berorientasi pada kepentingan para pekerja berupa pemulihan hak pekerja yang menjadi korban karena mendapatkan upah di bawah ketentuan upah minimum; (b) menerapkan konsep sanksi pidana restitusi (pembayaran ganti kerugian bagi para pekerja) dengan tujuan untuk memperbaiki kerugian yang disebabkan oleh tindak pidana korporasi dan memfasilitasi terjadinya perdamaian; (c) menerapkan ide double tract system (sanksi pidana dan sanksi penindakan) bagi korporasi yang membayar upah di bawah ketentuan upah minimum. / Workers who receive wages below the minimum wage provisions are not enough to provide a decent living, meaning that the amount of wages does not reflect the value of justice for workers. There are three problems raised in this dissertation research, namely; (1) regulations regarding the criminal liability of corporations that pay wages below the current minimum wage in Indonesia; (2) implementation of criminal liability for corporations that pay wages below the minimum wage; and (3) ideal arrangements regarding criminal liability for corporations that pay wages below the minimum wage based on justice values in Indonesia in the future. To analyze these three problems, a normative juridical method is used with three legal theories used for analysis, namely criminal theory, Lawrence M Friedman's legal system theory and dignified justice theory. The findings of this research are (1) regulations regarding criminal liability of corporations that pay wages below the minimum wage in Indonesia which are generally regulated in Law Number 13 of 2003 concerning Employment and Law Number 6 of 2020 concerning Job Creation. Wage policy is specifically regulated in Government Regulation Number 36 of 2021 concerning Wages, while Government Regulation Number 51 of 2023 only changes the minimum wage increase formula previously regulated in Government Regulation Number 36 of 2021. (2) Implementation of criminal liability for corporations that pay wages below The minimum wage in Indonesia still experiences many problems, especially the problem of corporate actions because the nature and existence of corporations as legal subjects is different from the nature and existence of humans (natuurlijke person) as legal subjects. (3) The ideal arrangement regarding criminal liability for corporations that pay wages below the minimum wage based on the value of justice in Indonesia in the future is (a) the ideal type of criminal punishment imposed on corporations, namely oriented towards the interests of workers in the form of restoring the rights of workers who have become victims because they received wages below the minimum wage provisions; (b) apply the concept of criminal restitution sanctions (payment of compensation to workers) with the aim of repairing losses caused by corporate criminal acts and facilitating peace; (c) implementing the idea of a double tract system (criminal sanctions and enforcement sanctions) for corporations that pay wages below the minimum wage provisions.
