Abstract

In a world where the international system has advanced much in the prevention of large-scale wars, there are still instances where it overlooked regional conflicts. One of these conflicts is the Russo-Ukraine war. Russia, as one of its parties, has conducted internationally recognized unlawful acts. In the base of the Russian political system is Vladimir Putin and the immense power he has as the president. This thesis takes this phenomenon and aims to observe and compare the difference between Vladimir Putin’s domestic conducts and Russia’s actions in the conflict. This research is done by comparing both national and international conduct with the relevant law, and drawing a conclusion with the neoclassical realism model in comparing the two to an international systemic incentive, balance of power. Through the research, this thesis concludes that Russia’s domestic law has been tinkered in a way that makes words ambiguous and so called “unfair” actions may have been justified. In comparison, Russia’s international actions in the conflict have proven to broke many international laws. The reason behind these two actions can be traced back to the balance of power centralized on Putin. Putin simply did not want to lose power and used strategies such as balancing and buck-passing in both domestic and international instances. Such strategies, and how the state centralizes on Putin, explains why certain irrational actions can be taken by a state and a leader. / Dalam dunia di mana sistem internasional telah banyak mengalami kemajuan dalam pencegahan perang, masih ada beberapa kasus di mana sistem ini mengabaikan konflik regional. Salah satu-nya adalah perang Rusia-Ukraina. Rusia, sebagai salah satu pihak, telah melakukan tindakan melanggar hukum internasional. Sistem politik Rusia yang menitik-beratkan Vladimir Putin dan kekuasaan besar yang dimilikinya sebagai presiden. Untuk menyelidiki salah satu penyebab utama dari konflik tersebut, penelitian ini bertujuan untuk mengamati dan membandingkan perbedaan antara perilaku domestik Vladimir Putin dan tindakan Rusia dalam konflik. Penelitian ini dilakukan dengan membandingkan perilaku nasional dan internasional dengan hukum yang relevan, dan menarik kesimpulan dengan model realisme neoklasik dalam membandingkan keduanya dengan insentif dari sistem internasional, yaitu balance of power. Melalui penelitian ini, disimpulkan bahwa hukum domestik Rusia telah dirubah sedemikian rupa sehingga membuat isinya menjadi ambigu dan apa yang disebut sebagai tindakan “tidak adil” dapat dijustifikasi. Sebagai perbandingan, tindakan internasional Rusia dalam konflik dengan Ukraina telah terbukti melanggar banyak hukum internasional. Alasan di balik kedua tindakan ini dapat ditelusuri kembali dengan melihat balance of power yang terpusat pada Putin. Putin tidak ingin kehilangan kekuasaan dan menggunakan strategi seperti “balancing” dan “buck-passing” baik di ranah domestik maupun internasional. Strategi tersebut, dan bagaimana negara terpusat pada Putin, menjelaskan mengapa tindakan-tindakan irasional tertentu dapat dilakukan oleh negara dan pemimpin-nya.
