Penelitian hukum ini bertujuan untuk mengetahui keududukan anak kandung yang berbeda agama dengan pewaris karena Kompleksitas waris akan meningkat dalam hal pewarisan berbeda agama yaitu terhadap anak kandung berbeda agama dengan Pewaris . Menurut fenomena pewarisan terhadap ahli waris beda agama dengan pewaris semakin meningkat dan terlebih kasus yang di angkat penulis yaitu Putusan pengadilan Agama Jakarta Selatan Nomor: 3565/Pdt.G/2014/PA.JS dimana hakim yang memutus memberikan hak mewaris kepada ahli waris yang berbeda agama dengan pewarisnya ( beragama Islam) dan hal tersebut bertentangan dengan aturan hukum di Indonesia yaitu Kompilasi Hukum Islam yaitu pasal 171 butir (c) Kompilasi Hukum Islam dan Al-Qur’an, Hadist dan Ijma. Penelitian dengan metode yuridis normatif ini memiliki tujuan untuk mengetahui hak waris anak kandung yang berbeda agama dengan ayah kandungnya (pewaris )berdasarkan hukum waris Islam oleh karenanya, peneliti sangat tertarik untuk mengambil judul Tesis sebagai berikut : “Pembagian Harta Warisan Terhadap Anak Kandung Berbeda Agama dengan Pewaris Putusan Pengadilan Agama Nomor: 3565/Pdt.G/2014/PA.JS Berdasarkan Hukum Waris Islam”. / This legal research aims to find out the biological status of children of different religions from the heirs because the complexity of inheritance will increase in terms of inheritance of different religions, namely to biological children of different religions from inheritors. According to the phenomenon of inheritance of heirs of different religions with heirs is increasing and especially the case that was appointed by the author of the Decision of the South Jakarta Religious Court Number: 3565 / Pdt.G / 2014 / PA.JS where the judge who decides to give the right to inherit to different heirs religion with its heir (Muslim) and it is against the rule of law in Indonesia, namely the Compilation of Islamic Law, namely article 171 item (c) Compilation of Islamic Law.
