Abstract
In the midst of rapidly evolving lifestyles and global trends, the term Jastip has become increasingly familiar to the public. This concept has emerged as a practical solution for individuals seeking exclusive, rare, or location-specific items without the need to travel themselves. One of the central legal issues concerns consumer protection in Jastip transactions, particularly when consumers do not receive the entrusted goods. Another significant issue is the liability of courier or expedition companies in cases of lost goods, as illustrated by the Lalamove courier case. The purpose of this research is to explore legal protections for consumers involved in Jastip transactions where the entrusted goods are not delivered, and to examine the liability of expedition companies for losses caused by their couriers. This study employs a normative-juridical legal research approach, utilizing literature reviews, content analysis of legal documents, and deductive legal reasoning. In addressing these challenges, it is essential for the government to establish adaptive and responsive legal frameworks that reflect the evolving nature of digital transactions. Additionally, normative revisions are needed in the standard agreement clauses used by digital-based delivery service providers, to ensure alignment with the principles of justice, good faith, and consumer protection.
