Abstract

Penelitian ini mengkaji pertanggungjawaban hukum Pejabat Pembuat Akta Tanah (PPAT) pembuatan akta jual beli tanah yang dibatalkan oleh pengadilan karena dianggap cacat hukum. Fokus utama penelitian ini diarahkan pada bagaimana akibat dari akta jual beli yang dibuat berdasarkan utang piutang serta analisis tanggung jawab PPAT ketika akta yang dibuatnya tidak memenuhi ketentuan formil maupun materil sebagaimana diatur dalam peraturan perundang-undangan, sehingga menimbulkan kerugian bagi para pihak yang berkepentingan. Permasalahan ini menjadi krusial karena PPAT sebagai pejabat umum diberi wewenang untuk membuat akta otentik dalam bidang pertanahan. tindakan atau kelalaian PPAT dapat berdampak langsung terhadap kepastian hukum dan perlindungan hak-hak keperdataan para pihak. Penelitian ini menggunakan metode normatif-empiris dengan pendekatan kasus, yang difokuskan pada Putusan Mahkamah Agung Nomor 3507 K/Pdt/2023. Data diperoleh melalui studi kepustakaan yang meliputi peraturan perundang-undangan, doktrin hukum, serta analisis putusan pengadilan. Hasil penelitian menunjukkan bahwa PPAT dalam perkara ini tidak hadir dan tidak membacakan akta saat proses penandatanganan akta. Hal ini melanggar ketentuan Pasal 22 Peraturan Pemerintah Nomor 37 Tahun 1998 juncto Peraturan Pemerintah Nomor 24 tahun 2016 tentang Peraturan Jabatan PPAT. Akibatnya, akta tersebut dibatalkan oleh Mahkamah Agung dan PPAT dianggap telah melakukan pelanggaran hukum yang dapat menimbulkan pertanggungjawaban secara perdata, administratif, dan kode etik profesi. / This study examines the legal liability of Land Deed Officials (PPAT) in the execution of a sale and purchase deed of land that was subsequently annulled by the court due to legal defects. The primary focus is on the legal consequences of a deed based on a debt agreement and the extent of PPAT’s liability when the deed fails to meet both formal and material legal requirements as mandated by the prevailing laws and regulations, thereby causing harm to the parties involved. This issue is critical because PPATs, as public officials, are authorized to draw up authentic deeds in land affairs. Any act or omission by the PPAT may directly affect legal certainty and the protection of civil rights. The research employs a normative-empirical method with a case study approach, centered on the Supreme Court Decision Number 3507 K/Pdt/2023. Data were obtained through literature review, including legislation, legal doctrine, and court decision analysis. The findings reveal that the PPAT was neither present nor read the deed at the signing, violating Article 22 of Government Regulation No. 37 of 1998 in conjunction with Government Regulation No. 24 of 2016 on PPAT Regulations. As a result, the deed was annulled, and the PPAT was deemed to have committed legal violations incurring civil, administrative, and ethical responsibility.
