Abstract
Pengadaan tanah secara khusus diatur oleh Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah bagi Pembangunan Untuk Kepentingan Umum. Pengadaan tanah untuk kepentingan umum dilakukan dengan musyawarah untuk mencapai kesepakatan mengenai bentuk dan besarnya ganti kerugian. Asas kepentingan umum yang dinyatakan sebagai asas kepastian adalah memberikan kepastian hukum tersedianya tanah dalam proses pengadaan tanah untuk pembangunan dan memberikan jaminan kepada pihak yang berhak untuk mendapatkan ganti kerugian yang layak. Adapun rumusan masalah dalam penelitian ini adalah akibat hukum bagi pemegang hak atas tanah yang tidak mendapat ganti kerugian akibat pengadaan tanah dan penyelesaian sengketa bagi pemegang hak atas tanah yang tidak mendapat ganti kerugian akibat pengadaan tanah. Adapun penelitian ini bersifat normatif empiris, dengan menggunakan data sekunder yang didukung dan dikuatkan oleh data primer. Cara perolehan data dalam penelitian ini adalah dengan Data Sekunder yang didukung dengan Data Primer. Data Sekunder diperoleh melalui teknik (metode) pengumpulan data berupa “Studi Kepustakaan”, sedangkan Data Primer salah satunya dapat diperoleh dengan “Teknik Wawancara”. Pendekatan yang dilakukan adalah dengan pendekatan asas, sistematika, sinkronasi, dan kasus. Sifat analisis pada penelitian ini bersifat kualitatif sebab menguji kualitas substansi norma hukum, yang artinya rumusan pembenaran didasarkan pada kualitas dari pendapat-pendapat para ahli hukum, doktrin, teori, maupun dari rumusan norma hukum itu sendiri. Akibat hukum bagi objek pengadaan tanah tumpang tindih pada pengambilan gnati kerugian yang dikonsinyasi di pengadilan adalah tanahnya menjadi objek sengketa tumpang tindih sehingga uang konsinyasi tidak bisa langsung diambil oleh pemilik yang berhak. Upaya penyelesaian sengketa bagi pemegang hak atas tanah yang tidak mendapat ganti kerugian biasanya berupa konsinyasi di pengadilan. Hendaknya pemegang hak atas tanah menjaga kepemilikan dan merawat tanahnya, serta Pemerintah Indonesia untuk merevisi UU Pengadaan Tanah dalam hal memberikan sanksi pidana bagi pelaku yang memalsukan dokumen dan bagi pemegang hak atas tanah dapat mengajukan judicial review terhadap UU Pengadaan Tanah kepada Mahkamah Konsitutsi. / Land acquisition is specifically regulated by Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest. Land acquisition for public interest is carried out through deliberation to reach an agreement regarding the form and amount of compensation. The principle of public interest, stated as the principle of legal certainty, is to provide legal assurance for the availability of land in the land acquisition process for development and to guarantee that entitled parties receive fair compensation. The problems addressed in this research are the legal consequences for land rights holders who do not receive compensation due to land acquisition, and the dispute resolution mechanisms available to them. This research is normative-empirical in nature, using secondary data supported and reinforced by primary data. Data collection methods include obtaining secondary data through literature studies, while primary data is obtained, among other ways, through interviews. The research approach involves principles, systematics, synchronization, and case studies. The analysis is qualitative in nature, as it examines the quality of the legal norms’ substance, meaning that the justification is based on the quality of legal expert opinions, doctrines, theories, and the formulation of the legal norms themselves. The legal consequence for land acquisition objects with overlapping claims during court-ordered consignment of compensation is that the land becomes subject to overlapping dispute, which prevents the rightful owner from directly receiving the consigned funds. Dispute resolution efforts for land rights holders who do not receive compensation typically involve judicial consignment. Landowners are advised to maintain ownership and care for their land, and the Indonesian government is urged to revise the Land Acquisition Law, particularly to include criminal sanctions for individuals who forge documents. Furthermore, land rights holders may submit a judicial review of the Land Acquisition Law to the Constitutional Court.
