Abstract

Penelitian ini mengkaji perlindungan hukum bagi korban endorsement dalam konteks hukum positif Indonesia. Fenomena endorsement yang semakin marak di era digital, khususnya melalui media sosial, seringkali menimbulkan permasalahan hukum ketika produk atau jasa yang di-endorse tidak sesuai dengan ekspektasi atau bahkan merugikan konsumen. Kondisi ini menyoroti celah perlindungan hukum bagi konsumen yang menjadi korban akibat informasi yang menyesatkan atau praktik endorsement yang tidak bertanggung jawab. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk perlindungan hukum yang tersedia bagi korban endorsement menurut Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Pertama atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, dan Undang-Undang Nomor 1 Tahun 2024 tentang Perubahan Kedua atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Penelitian ini dilakukan melalui studi literatur untuk mengumpulkan data hukum primer dan sekunder, yang meliputi peraturan perundang-undangan, buku, jurnal ilmiah, serta artikel yang relevan dengan permasalahan penelitian. Penelitian ini menyimpulkan bahwa pembelian paket endorsement yang dilakukan secara digital pada umumnya memenuhi kriteria perjanjian menurut hukum perdata Indonesia, sebagaimana diatur dalam Pasal 1320 KUH Perdata. Serta, Pihak pelaku endorsement yang tidak memposting konten sesuai dengan apa yang diperjanjikan dalam perjanjian endorsement dapat dituntut wanprestasi menurut hukum Indonesia. Hal ini dikarenakan, perjanjian endorsement termasuk perjanjian dan mengandung prestasi didalamnya. / This research examines the legal protection for endorsement victims within the context of Indonesian positive law. The escalating phenomenon of endorsement in the digital era, particularly through social media, often leads to legal issues when endorsed products or services do not meet expectations or even cause harm to consumers. This condition highlights a gap in legal protection for consumers who become victims due to misleading information or irresponsible endorsement practices. This study aims to analyze the forms of legal protection available for endorsement victims according to the Indonesian Civil Code, Law Number 19 of 2016 concerning the First Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions, and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions. This research was conducted through a literature study to collect primary and secondary legal data, which includes laws and regulations, books, scientific journals, and articles relevant to the research problem. This study concludes that the digital purchase of endorsement packages generally meets the criteria for an agreement under Indonesian civil law, as stipulated in Article 1320 of the Civil Code. Furthermore, parties performing endorsements who do not post content in accordance with what was agreed upon in the endorsement agreement can be sued for breach of contract under Indonesian law. This is because an endorsement agreement is considered a contract and contains performance obligations.
