Abstract

The Notary public is a profession that has an important role in the community to regulate the civil relations among the community. The Notary in his position shall be subject to the oath of office, UUJN, Notary Code of Ethics and other laws. UUJN said the Notary has the authority and obligation to make authentic deeds and other documents and store them as part of the notary protocol. Then according to UUJN, this notary protocol is a State archive (article 1 point 13 UUJN) that must be stored and managed properly by the Notary so as not to be lost, damaged, or misplaced. For notarial protocols that are aged 25 (twenty-five) years or older, UUJN governs that the protocol of notaries must be submitted to the MPD (Article 63 paragraph (5) UUJN). However, in fact, MPD does not have an adequate place to store the protocol of notary. Consequently, this raises problems for both Notary and MPD. Because MPD has not been able to accommodate the protocol of notary, the Notary public is still responsible for storing its notarial protocols until the time which cannot be determined. In addition, since 2017 the Government has held the "GNSTA" program to invite the whole community, government institutions, and other professions to carry out the “GNSTA” program. The Archives Act and the "GNSTA" Program do not strictly govern the obligation of the Notary to execute an orderly archive. However, because the notary protocol is one of the country's archives, the Notary still needs to play an active role in the program. Awareness of the management of this archive will be tightened in the lack of chaos and provide facilities for the parties concerned, especially for Notary, to obtain certain information on the deeds that have been made by it. / Notaris adalah profesi yang memiliki peran penting dalam masyarakat untuk mengatur hubungan-hubungan keperdataan di antara masyarakat. Notaris dalam menjalankan jabatannya harus tunduk pada sumpah jabatannya, Undang-Undang Jabatan Notaris (selanjutnya disebut UUJN), Kode Etik Notaris serta Undang-Undang lainnya. UUJN mengatakan bahwa Notaris memiliki kewenangan dan kewajiban untuk membuat akta autentik dan dokumen-dokumen lainnya serta menyimpannya sebagai bagian dari Protokol Notaris. Kemudian menurut UUJN, Protokol Notaris ini merupakan Arsip Negara (Pasal 1 angka 13 UUJN) yang harus disimpan dan dikelola dengan baik oleh Notaris agar tidak hilang, rusak, atau tercecer. Untuk Protokol Notaris yang telah berumur 25 (dua puluh lima) tahun atau lebih, UUJN mengatur bahwa Protokol Notaris tersebut harus diserahkan kepada Majelis Pengawas Daerah (selanjutnya disebut MPD) (Pasal 63 ayat (5) UUJN). Akan tetapi pada kenyatannya, MPD belum memiliki tempat yang memadai untuk menyimpan Protokol Notaris tersebut. Akibatnya hal ini menimbulkan persoalan baik bagi Notaris maupun MPD. Dikarenakan MPD belum mampu menampung Protokol Notaris tersebut, maka Notaris tetap berperan untuk menyimpan Protokol Notarisnya sampai waktu yang tidak dapat ditentukan. Disamping itu, Pemerintah sejak tahun 2017 telah mengadakan Program Gerakan Nasional Sadar Tertib Arsip (Selanjutnya disebut Program “GNSTA”). Undang-Undang Kearsipan dan Program “GNSTA” memang tidak mengatur secara tegas mengenai kewajiban Notaris untuk melaksanakan tertib arsip. Akan tetapi, dikarenakan Protokol Notaris merupakan salah satu arsip Negara, maka Notaris tetap perlu berperan aktif dalam program tersebut. Kesadaran pengelolaan arsip ini akan mengerucut pada minimnya kekacauan dan memberikan kemudahan bagi para pihak yang berkepentingan, khususnya bagi Notaris, untuk mendapatkan informasi tertentu atas akta-akta yang telah dibuat olehnya.
