Abstract
Transformasi digital dalam sistem pertanahan Indonesia ditandai dengan diterapkannya sertipikat elektronik yang menjadi bagian dari modernisasi administrasi pertanahan. Penelitian ini bertujuan untuk mengkaji kekuatan hukum sertipikat elektronik dalam perjanjian jual beli tanah dan mengevaluasi perlindungan hukum bagi konsumen pembeli rumah sesuai dengan Peraturan Menteri ATR/BPN Nomor 3 Tahun 2023 tentang penerbitan dokumen elektronik dalam kegiatan pendaftaran tanah. Dengan menggunakan metode yuridis normatif dan pendekatan peraturan perundang-undangan serta teori hukum, ditambah wawancara dengan pejabat Kantor Wilayah ATR/BPN, penelitian ini menemukan bahwa secara normatif, sertipikat elektronik memiliki kekuatan hukum yang setara dengan sertipikat analog. Namun, dalam praktik, masih terdapat kendala yang mengganggu prinsip kepastian hukum, terutama pada sertipikat hasil pemecahan dari induk milik developer yang sering tidak mencantumkan informasi secara lengkap. Kondisi ini menimbulkan potensi sengketa dan melemahkan perlindungan hukum terhadap konsumen. Di sisi lain, keterbatasan akses informasi melalui aplikasi Sentuh Tanahku turut memperburuk situasi. Oleh karena itu, diperlukan harmonisasi regulasi, peningkatan transparansi data, serta penguatan pengawasan dan pedoman teknis agar penerapan sistem pertanahan elektronik benar-benar menjamin kepastian dan perlindungan hukum yang adil bagi semua pihak. / The digital transformation of Indonesia's land administration system is marked by the implementation of electronic land certificates as part of the modernization process. This study aims to examine the legal force of electronic certificates in land sale and purchase agreements and to evaluate legal protection for homebuyers in accordance with the Minister of ATR/BPN Regulation Number 3 of 2023 regarding the issuance of electronic documents in land registration activities. Using a normative juridical method with a statutory and legal theory approach, supported by interviews with officials from the Regional Office of ATR/BPN, the research finds that, normatively, electronic certificates hold equal legal force to analog certificates. However, in practice, there are still obstacles that undermine the principle of legal certainty, particularly with certificates issued from subdivisions of a developer’s master certificate, which often lack complete information. This situation poses potential legal risks and weakens consumer protection. Furthermore, limited access to information through the Sentuh Tanahku application exacerbates the issue. Therefore, regulatory harmonization, improved data transparency, and strengthened supervision and technical guidelines are necessary to ensure that the electronic land administration system truly guarantees legal certainty and fair legal protection for all parties involved.
