Abstract
Penelitian ini menganalisis bagaimana perbuatan melawan hukum dalam pensertipikatan hak atas tanah yang tidak sesuai dengan ketentuan PP No. 24 Tahun 1997 dan PP No. 18 Tahun 2021 dan penggunaan sertipikat palsu sebagai dasar
gugatan perkara pembatalan hak atas tanah dalam perkara perdata Nomor1520K/PDT/2024 ditinjau dari UUPA. Dalam metode penelitian yang digunakan adalah penelitian normatif empiris dengan mengutamakan data sekunder dan cara perolahan data yang digunakan yakni studi kepustakaan dengan pendekatan asasasas hukum, sinkronisasi hukum dan pendekatan kasus serta menggunakan teknik analisis data kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa
setiap pemberian hak atas tanah harus memenuhi tiga unsur utama yakni alas hak yang sah, subjek hukum yang sesuai dan objek tanah yang dapat diberikan hak
menurut peraturan perundang-undangan yang berlaku. Ketentuan ini secara tegas diatur dalam UUPA, PP No. 24 Tahun 1997, yang menekankan pentingnya kepastian hukum dalam pendaftaran tanah, serta PP No. 18 Tahun 2021 yang
memperjelas subjek dan objek hak atas tanah. Permasalahan muncul ketika pensertipikatan dilakukan dengan tidak memenuhi syarat legal untuk memiliki atau
menguasai tanah tertentu. Maka tindakan semacam ini tidak hanya cacat secara administratif, tetapi juga dapat dikualifikasikan sebagai perbuatan melawan hukum
karena melanggar norma hukum tertulis, asas-asas hukum publik, serta berpotensi menimbulkan kerugian baik terhadap negara maupun masyarakat luas. / This study analyzes the tort in the land title certificate that is not in accordance with the provisions of Government Regulation No. 24 of 1997 and Government Regulation No. 18 of 2021, as well as the use of a fake certificates as the basis for a lawsuit to cancel land title in the civil case Number 1520K/PDT/2024, viewed from the perspective of the Basic Agrarian Law (UUPA). The research method used is empirical normative, prioritizing secondary data, with data collection carried out through literature review and a legal principle approach, legal synchronization, and case study methods, using qualitative data analysis techniques. Based on the results of the study, every granting of a land title must meet three main elements, namely a valid legal basis, a qualified legal subject, and a land object that can be granted
for rights according to the applicable regulations and laws. These requirements are explicitly regulated in the UUPA and Government Regulation No. 24 of 1997, which emphasizes the importance of legal certainty in land registration, and
Government Regulation No. 18 of 2021 which clarifies the subject and object of land title. Problems arise when certification is carried out without fulfilling the legal
requirements to own or control a certain land. These actions are not only administratively flawed, but it may also be classified as tort for breaching written legal norms, public law principles, and it carries the potential to cause losses to both the state and the broader society.
