Abstract
Penelitian ini membahas mengenai tanggung jawab Pejabat Pembuat Akta Tanah (PPAT) atas penandatanganan blangko kosong Akta Jual Beli. Latar belakang penelitian ini bermula dari sengketa yang terjadi akibat dari kelalaian PPAT sebagai pejabat umum yang mempunyai kewenangan untuk membuat akta autentik. Seyogyanya akta autentik tersebut memiliki pembuktian yang sempurna dan bertujuan untuk memberikan kepastian hukum pemegang Hak atas Tanah atau Hak Milik atas satuan Rumah Susun. Fokus penelitian ini mengkaji pengaturan pertanggung jawaban PPAT dan akibat hukum dari Akta Jual Beli yang didasari oleh penandatanganan blanko kosong tersebut (Studi Kasus Putusan Nomor 3507 K/Pdt/2023); dengan metode penelitian hukum normatif yang dengan teknik pengumpulan data ialah studi kepustakaan (library research). Hasil Penelitian ini penulis menemukan bahwa PPAT yang menjalankan kewenangannya tidak sesuai dengan peraturan yang berlaku atau melakukan unsur kesengajaan, kealpaan atau kelalaian dapat dikenakan sanksi administratif, sanksi keperdataan dan juga sanksi pidana dan akibat hukum atas akta autentik yang dibuat ialah menjadi batal demi hukum atau mengalami degradasi kekuatan hukum. / This study discusses the responsibility of the Land Deed Official (PPAT) for signing the blank form of the Sale and Purchase Deed. The background of this study began with a dispute that occurred due to the negligence of the PPAT as a public official who has the authority to make authentic deeds. Authentic deeds have perfect proof and aim to provide legal certainty for the community as holders of Land Rights or Ownership Rights for Apartment Units. The focus of this study examines the regulation of PPAT's accountability and the legal consequences of the Sale and Purchase Deed based on the signing of the blank form (Case Study of Decision Number 3507 K/Pdt/2023); using a normative legal research method with a data collection technique of library research. The results of this study found that PPAT who exercise their authority not in accordance with applicable regulations or carry out elements of intent, negligence or negligence can be subject to administrative sanctions, civil sanctions and also criminal sanctions and the legal consequences of the authentic deeds made are that they become null and void or experience a degradation of legal force.
