Abstract

PT Mahakarya Agung Putera as a developer previously undertook to complete the construction and to physically hand over the flats in December 2016, but PT Mahakarya Agung Putera as a developer was unable to hand over the flat units to the purchasers on the agreed time.The objective of this writing is to find out the legal protection to the consumers of a developer who is declared bankrupt by studying the case of Grand Eschol Residences flat units. This descriptive analytical study is conducted by library research method. Based on the analysis on the discussion, it can be concluded that bankruptcy causes general confiscation of the flat unit developer’s assets, including the flat units which have been fully paid by the purchasers. By law the purchasers who have made full payment for the flat units based on Conditional Sale and Purchase Agreement (CSPA) are not the owners of the flat units, but the concurrent creditors of the developer due to the fact that the developer has not factually and legally transfer the ownership to the flat units to the purchasers. Consequently, by law the ownership right to the flat units remains with the developer and the said flat units become the bankruptcy assets of the developer. Attempts through Suspension of Debt Settlement Obligation (Penundaan Kewajiban Pembayaran Utang or PKPU) and/or mediation had been taken by the consumers as the alternative solution to the issue but the developer offered a composition plan which according to the consumers’ assessment and calculation inflicts loss to the consumers. The consumers opted to have the developer declared bankrupt in hope of receiving higher amount of refund from the proceeds of the developer assets compared to the composition plan offered by the developer. / PT Mahakarya Agung Putera sebagai developer berjanji akan menyelesaikan pembangunan serta melakukan penyerahan rumah susun secara fisik pada bulan Desember 2016, tetapi pada waktu yang telah ditentukan PT Mahakarya Agung Putera sebagai developer tidak dapat menyerahkan bangunan unit rumah susun tersebut kepada pembelinya. Tulisan ini bertujuan untuk mengetahui perlindungan hukum terhadap konsumen yang developernya dinyatakan pailit dengan meneliti kasus yang terjadi pada sarusun Grand Eschol Residences. Penelitian deskriptif analitis ini menggunakan metode penelitian kepustakaan. Berdasarkan analisa pada pembahasan diperoleh kesimpulan bahwa kepailitan mengakibatkan sita umum atas harta kekayaan developer Sarusun, termasuk Sarusun yang telah dilunasi oleh pembelinya. Status hukum pembeli Sarusun yang telah melunasi pembayarannya berdasarkan Perjanjian Pengikatan Jual Beli (PPJB) bukan sebagai pemilik Sarusun, melainkan sebagai kreditur konkuren dari developer Rusun karena belum menyerahkan kepemilikan Sarusun baik secara faktual maupun yuridis dari developer kepada pembelinya. Akibatnya, hak kepemilikan Sarusun tersebut secara yuridis ada pada developer dan menjadi harta pailit developer. Penundaan Kewajiban Pembayaran Utang (PKPU) dan/atau upaya mediasi telah ditempuh oleh konsumen sebagai alternatif penyelesaian permasalahan tetapi developer menawarkan rencana penyelesaian (refund) perdamaian yang menurut penilaian dan perhitungan konsumen sangat merugikan. Konsumen memilih mempailitkan developer dengan harapan penjualan aset developer dapat mengembalikan dana (refund) konsumen lebih baik daripada penawaran perdamaian yang diajukan developer.
