Abstract

Pada kegiatan jual-beli dalam pertanahan nasional, tentu peran Notaris sangat dibutuhkan. Merupakan kewajiban dari Notaris untuk membuatkan akta-akta perjanjian bersifat otentik khususnya dalam bidang pertanahan. Terdapat dua akta otentik yang berhubungan dalam sistem jual-beli hak atas tanah yaitu, Akta Jual Beli yang dibuat oleh Pejabat Pembuat Akta Tanah dan Perjanjian Pengikatan Jual Beli yang dibuat oleh Notaris. Perjanjian Pengikatan Jual Beli dilakukan apabila ada kondisi tertentu yang membuat suatu subjek atau objek jual-beli belum dapat dilaksanakan namun kesepakatan sudah terjadi. Pada Perjanjian Pengikatan Jual Beli ini biasanya dicantumkan suatu kuasa mutlak yang penggunaanya dilarang oleh peraturan perundang-undangan di Indonesia. Rumusan permasalahan yang dikaji pada penelitian ini adalah kedudukan kuasa mutlak dan karakteristik dari kuasa mutlak setelah dicabutnya Instruksi Mendagri No.14 Tahun 1982. Tujuan penelitian ini adalah untuk memecahkan persoalan hukum mengenai kedudukan kuasa mutlak dan karakteristiknya setelah dicabutnya Instruksi Mendagri No. 14 Tahun 1982. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukan bahwa kedudukan kuasa mutlak merupakan pelimpahan wewenang delegasi dan bersifat sebagai perjanjian tambahan yang melekat dan tidak terpisahkan dari perjanjian pokoknya yaitu Perjanjian Pengikatan Jual Beli. Penggunaan kuasa mutlak dibedakan dalam dua tujuan yaitu sebagai dasar pengalihan hak atas tanah dan sebatas bentuk kepastian hukum pembeli. Kuasa mutlak sebagai dasar peralihan hak atas tanah melanggar ketentuan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah berakibat tidak memenuhi syarat sahnya perjanjian dan dapat membuat akta otentik batal demi hukum. Pada kuasa mutlak sebatas kepastian hukum pembeli tidak termasuk sebagai kuasa mutlak yang dimaksud pada Instruksi Mendagri No.14 Tahun 1982 dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, sehingga kekuatan pembuktian PPJB yang dibuat oleh Notaris adalah sempurna, dan tidak bertentangan dengan hukum. / In the sale and purchase activities in national land, of course, the role of a Notary is very much needed. It is the obligation of Notary to make authentic deeds of agreement, especially in the field of land. There are two authentic deeds related to the land rights sale and purchase system, namely, the Sale and Purchase Deed made by the Land Deed Making Officer and the Sale and Purchase Binding Agreement made by the Notary. The Sale and Purchase Binding Agreement is made if certain conditions make a subject or object of sale and purchase cannot be implemented but the agreement has already occurred. In this Sale and Purchase Agreement, an absolute power of attorney is usually stated, the use of which is prohibited by laws and regulations in Indonesia. The formulation of the problem studied in this study is the position of absolute power and the characteristics of absolute power after the revocation of the Minister of Home Affairs Instruction No. 14 of 1982. The purpose of this study is to solve the legal problem regarding the position of absolute power and its characteristics after the revocation of the Minister of Home Affairs Instruction No. 14 of 1982. The research method used is normative juridical. The study results indicate that the position of absolute power of attorney is a delegation of authority and is an additional agreement that is inherent and inseparable from the main agreement, namely the Sale and Purchase Agreement. The use of absolute power of attorney is divided into two purposes, namely as a basis for transferring land rights and limited to a form of legal certainty for the buyer. The absolute power of attorney as a basis for the transfer of land rights violates the provisions of Government Regulation Number 24 of 1997 concerning Land Registration, resulting in not meeting the requirements for the validity of the agreement and can make the authentic deed null and void. In absolute power limited to the legal certainty of the buyer, it is not included as absolute power of attorney as referred to in the Instruction of the Minister of Home Affairs No. 14 of 1982 and Government Regulation Number 24 of 1997 concerning Land Registration, so that the evidentiary force of the PPJB made by the Notary is perfect, and does not contrary to the law.
