Abstract

Pejabat Pembuat Akta Tanah (untuk selanjutnya disebut dengan “PPAT”) adalah seorang pejabat umum yang diberikan wewenang untuk membuat akta otentik yang berhubungan dengan hak atas tanah. Dalam menjalankan tugasnya tentu seorang PPAT memiliki kewajiban untuk menentukan otentisitas akta yang ia buat. Dalam perannya sebagai pejabat umum, PPAT harus bertanggungjawab atas profesinya. Dalam Tesis ini rumusan masalah adalah bagaimana pertanggungjawaban PPAT terhadap objek Akta Jual Beli yang ia buat tetapi kemudian mengalami sengketa tumpang tindih kepemilikan hak atas tanah serta bagaimana penyelesaian sengketa kepemilikan hak atas tanah tumpang tindih berdasarkan Putusan Putusan Tingkat Pertama Nomor 117/Pdt.G/2019/PN.Blb dan Putusan Banding Nomor 344/PDT/2020/PT.BDG. Untuk menjawab rumusan masalah tersebut diperlukan penelitian yang meggunakan jenis penelitian normatif empiris dengan menggunakan data primer dan data sekunder yang dianalisis secara kualitatif. Dari hasil penelitian tersebut, dapat disimpulkan bahwa dalam menjalankan tugasnya seorang PPAT memiliki tanggungjawab untuk menerapkan prinsip kehati-hatian untuk memberikan kepastian hukum atas akta yang ia buat. Selain itu selama PPAT melakukan kewajibannya sesuai dengan apa yang diatur oleh Peraturan Perundang-undangan serta dapat membuktikannya maka PPAT tersebut terlepas dari pertanggungjawaban hukum atas sengketa tumpang tindih objek akta jual beli yang ia buat. Dapat disimpulkan bahwa pertanggungjawaban PPAT sampai pada akta yang ia buat saja. Penyelesaian sengketa tumpang tindih dapat dibuktikan dengan sertipikat kepemilikan hak atas tanah serta pemeriksaan setempat. Dalam Putusan yang diteliti, sertipikat kehilangan kepastian hukumnya karena tidak dibuat dengan implementasi hukum yang seharusnya. / Land Deed Making Official (hereinafter referred to as "PPAT") is a public official who is authorized to make authentic deeds related to land rights. In carrying out his duties, of course, a PPAT has an obligation to determine the authenticity of the deeds he makes. In his role as a public official, PPAT must be responsible for his profession. In this thesis, the formulation of the problem is how is the PPAT's responsibility for the object of the Sale and Purchase Deed that he made but then experienced a dispute over overlapping ownership of land rights and how to resolve disputes over overlapping land rights based on the First Level Decision Number 117 / Pdt.G / 2019 / PN.Blb and Appeal Decision Number 344 / PDT / 2020 / PT.BDG. To answer the formulation of the problem, research is needed that uses the type of empirical normative research using primary data and secondary data that are analyzed qualitatively. From the results of this study, it can be concluded that in carrying out his duties, a PPAT has the responsibility to apply the principle of prudence to provide legal certainty for the deeds he makes. In addition, as long as the PPAT carries out his obligations in accordance with what is regulated by the Laws and can prove it, the PPAT is free from legal responsibility for disputes over overlapping objects of the sale and purchase deeds he made. It can be concluded that the PPAT's responsibility is limited to the deeds he made only. The settlement of overlapping disputes can be proven by a certificate of land ownership and a local inspection. In the Decision studied, the certificate lost its legal certainty because it was not made with the proper implementation of the law.
