Abstract

Pejabat Pembuat Akta Tanah (PPAT) memiliki peran penting dalam sistem hukum pertanahan di Indonesia, terutama dalam pembuatan Akta Jual Beli (AJB) tanah yang memiliki kekuatan hukum otentik. Tanggung jawab PPAT dalam proses ini tidak bersifat absolut, melainkan terbatas pada aspek administratif yang mencakup verifikasi dokumen dan memastikan prosedur hukum telah dipenuhi. Meskipun demikian, dalam praktiknya, tanggung jawab PPAT sering kali disalahpahami oleh masyarakat, yang menganggap akta yang dibuat oleh PPAT menjamin keabsahan materiil tanah yang terlibat. Penelitian ini bertujuan untuk mengkaji batasan tanggung jawab PPAT dalam pembuatan AJB, baik dari perspektif normatif yang diatur oleh undang-undang maupun dalam implementasinya di lapangan. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan kualitatif, mengkaji peraturan perundang-undangan yang berlaku, seperti Peraturan Pemerintah No. 24 Tahun 1997 dan Peraturan Menteri ATR/BPN No. 2 Tahun 2018 tentang PPAT. Hasil penelitian menunjukkan bahwa PPAT hanya bertanggung jawab atas kelengkapan administratif dan prosedural, sedangkan kesalahan substansial dalam status hukum tanah atau dokumen yang tidak sah di luar kewenangannya. Faktor-faktor yang mempengaruhi pelaksanaan tanggung jawab PPAT meliputi keterbatasan informasi dan kesulitan dalam verifikasi data pertanahan. Penelitian ini juga memberikan rekomendasi untuk meningkatkan pemahaman masyarakat tentang peran PPAT dan perlunya perbaikan regulasi yang lebih jelas mengenai batasan tanggung jawab tersebut agar tercipta kepastian hukum yang lebih baik di bidang pertanahan. / The Land Deed Official (PPAT) plays a crucial role in Indonesia's land law system, especially in the creation of the Sale and Purchase Deed (AJB), which holds authentic legal power. The responsibility of the PPAT in this process is not absolute, but rather limited to administrative aspects, including document verification and ensuring legal procedures are followed. However, in practice, the responsibility of PPAT is often misunderstood by the public, who assume that the deed created by the PPAT guarantees the material validity of the land involved. This study aims to examine the limits of PPAT's responsibility in the creation of the AJB, from both a normative perspective regulated by the law and its implementation in the field. The research method used is normative legal research with a qualitative approach, reviewing the applicable laws such as Government Regulation No. 24 of 1997 and Minister of ATR/BPN Regulation No. 2 of 2018 regarding PPAT. The research findings indicate that the PPAT is only responsible for administrative and procedural completeness, while substantial errors in the legal status of land or fraudulent documents are beyond its authority. Factors affecting the implementation of PPAT’s responsibility include limited information and difficulties in land data verification. This study also provides recommendations for improving public understanding of the role of PPAT and the need for clearer regulations regarding the limits of responsibility to ensure better legal certainty in land transactions.
