Abstract

Bank sebagai lembaga keuangan, memiliki peranan vital dalam menghimpun dana dan menyalurkan pinjaman kepada masyarakat. Pemberian kredit dilengkapi dengan pemberian jaminan sebagai perlindungan bagi bank yang memberikan pinjaman, agar mengurangi risiko apabila debitur mengalami wanprestasi. Jaminan kredit dapat berupa barang bergerak atau tidak bergerak, yang memiliki nilai ekonomis dan dapat dijadikan jaminan untuk melindungi bank sebagai kreditur. Salah satu bentuk jaminan khususnya bagi pedagang pasar, adalah Sertifikat Hak Pemakaian Tempat Usaha (SHPTU). SHPTU merupakan bukti kepemilikan hak pemakaian tempat usaha yang dapat digunakan oleh pedagang pasar sebagai jaminan untuk mendapatkan kredit dari bank. Namun, dalam prakteknya, bank seringkali hanya menerima SHPTU sebagai jaminan tambahan, bukan sebagai jaminan utama, karena status hukum terkait dengan hak atas tanah dan bangunan pasar masih belum diatur secara jelas dalam peraturan perundang-undangan di Indonesia.. Sehubungan dengan kesimpulan atas rumusan masalah pada penelitian ini adalah regulasi mengenai SHPTU tidak banyak memberikan kepastian hukum kepada debitur maupun kreditur sehingga saran yang dapat Penulis berikan adalah kedudukan SHPTU harus lebih diperjelas lagi sebagai hak pakai bukan hak milik karena hal ini menimbulkan kekhawatiran akan timbulnya pandangan hukum yang berbeda-beda. Penelitian ini diharapkan dapat memberikan kontribusi dalam penyempurnaan regulasi terkait dengan jaminan kredit dan memberikan solusi bagi masalah hukum. / Banks, as financial institutions, play a vital role in collecting public funds and distributing loans to the community. In credit lending, collateral is commonly required as a protection for the bank against the risk of default by the debtor. This collateral can be either movable or immovable assets that hold economic value and serve to secure the bank as the creditor. One form of collateral, particularly used by market traders, is the Certificate of Right to Use Business Premises (SHPTU). SHPTU is a certificate that proves the right to use a commercial space, which can be used by market traders as collateral to obtain loans from banks. However, in practice, banks often treat SHPTU as supplementary rather than primary collateral due to the unclear legal status of land and market buildings, which remains poorly regulated under Indonesian law. Based on the findings, this research concludes that current regulations do not provide sufficient legal certainty for either debtors or creditors regarding SHPTU. Therefore, it is recommended that SHPTU be clearly categorized as a right of use rather than ownership to avoid conflicting legal interpretations. This research aims to contribute to improving credit guarantee regulations and offer solutions to related legal issues.
