The role of a notary in sale and purchase transactions involving a Sale and Purchase Binding Agreement (Perjanjian Pengikatan Jual Beli or PPJB) and elements of debt is crucial in ensuring legal certainty for all parties involved. However, in practice, legal problems still occur such as granting power of attorney to sell before full payment has been made potentially harming the seller and leading to legal disputes. This study is motivated by a specific case reflected in Decision No. 347/Pdt.G/2020/PN Batam, where the responsibilities of the notary came under scrutiny. The purpose of this research is to analyze the legal responsibilities of notaries in transactions involving PPJB and debt-related elements, and to assess the legal protection afforded to the parties involved based on a case study approach. The method used is normative juridical research with statutory, conceptual, and case study approaches. Data were obtained from legal literature, legislation, and court decisions. The results show that in this case, the notary failed to ensure the fulfillment of payment obligations prior to issuing a power of attorney to sell, which later led to a legal dispute between the buyer and seller. Although the deed serves as legal evidence, it cannot guarantee substantial justice without thorough verification. In conclusion, notaries hold both legal and ethical responsibilities to ensure not only the formal legality of deeds but also the material fairness, thereby preventing future disputes.
